So I sold my phone on eBay, it was basically perfect, new battery and looked after went tracked

2 days later, “broken rear camera”. Well no it wasn’t but reluctantly send it back, I paid for the postage back, also tracked.

Anyway, it never got here but someone in Huddersfield has signed for it so ebay refunded them.

I’m currently going through Royal Mail with an investigation and a hope to get whatever they sent back but as I paid for the postage and I didn’t send it I cannot claim anything from them as I’m not the sender....

So my only option is to pursue a refund with eBay, I expect the box to be empty and the label to be altered so it didn’t arrive at my house.

Has anyone had any success with this? Googling seems to say legal action like small claims court, it’s £186 btw so not a massive amount but I’d rather have it.

Any help is appreciated too
 
can the sender provide proof of postage to your address?

If tracked the sender would have been given a receipt showing the destination Post Code. If there is a clear sign of a fraudulent action maybe the Police is also an appropriate port of call???

yeah they should be able to send a scan of the receipt or at least the certificate of posting
 
I do live in Huddersfield yeah, the buyer hasn’t responded to me and I have sent lots of messages, eBay advised me over the phone to accept the return and deal with it when it was delivered back to me
 
As it was tracked, my tracked parcel label too, even though it’s not at my house, someone has signed for it and that is enough for them to release the money back to them.

eBay emailed me Wednesday morning saying it was delivered to me Tuesday and I had until Friday to refund the buyer so I disputed it saying I didn’t have the parcel but the tracking no. Said delivered and they automatically sided with the buyer

The police will not be able to help, I didn’t know but I was signed up to Argos click and collect delivery service (I was unaware, everyone is opted in until they untick it apparently) so I don’t have an address for them, just an Argos near by I assume. Argos delete their cctv after 30 days too, so there’s 2 weeks left of it but what are the chances they would be able to do anything?... probably nothing

So my issue now is just with eBay, eBay can chase the buyer, I don’t care, they’ve incorrectly refunded them, I just want to know where I stand if I can legally take them to small claims or how I go about it and if anyone on here has done it before?

You have the tracking number! What does the PoD say, as in the signature and the "name" of the recipient ~ if the name is yours or not then although you were not the sender I would think that a mis-delivered item as it obviously was not to your exact address should be of interest to the fraud department of the Post Office (NB I am of course making an assumption on that they have a customer accessible link to such a department if it exists?)

In other words is there a route to bypass the fact you were not the sender???

they are investigating right now, they have to get back to me tomorrow but they kept stating i am not the sender. The address i sent is different to the directions and they also have a gps location when they scan and drop off the parcel which is another different location too, so 3 different locations for the same code but only one is correct, the signature is not me, i have a name but cant find it in the local directory either.

i am also hoping they weighed the parcel on its way back to me and i can have a letter to say it either didnt weigh enough, or someone else has opened it and it was not an iphone with my serial number or a phone at all.

you would think its a miss delivery and i would be able to claim from the royal mail but im unsure how much i can claim as it didnt actually ask me for an amount on the return post, i did it online.

I hope the PO can resolve this appropriately and yet mean you get your money back!

On a sidenote ~ there was a TV program recently that included talking about insurance fraud and one case was someone claiming for a mobile phone. The insurers mentioned using technology to determine if the phone was in use by detecting the IEMI number .......if the same tech can indicate the geographic location then potential to find it and who has misappropriated (stolen) it???
 
I tried Apple but it was wiped so they can’t help, the police 101 system can’t do anything and didn’t seem to care and I black listed the phone through all UK carriers with the IMEI no. After getting in touch with three

Hopefully I’ll get my empty package and eBay can refund me, ill have to wait and see ‍♂️
 
Well at least your actions mean AFAIK it is "bricked" so no one can benefit from its loss.

In regard to your last sentence, once you are able provide independent proof of its loss what action will e bay take against the other party.......fraud prosecution???
