ebay non payer Grrrrrr

So, a member wins my car on ebay. I have stated payment and collection within 7 days.

The bloke emails me and says "can I collect the car on saturday ?" 7 days after the auction end. I reply "yes, no problem, get back in touch with me towards the end of the week to confirm"

Saturday comes and no emails or phone calls.

I wait till about 10am and send an email asking weather or not he's comming for the car, no reply.

Nothing on Sunday.

Monday morning I open a dispute.

He replies to the dispute asking if he can collect the car the next Saturday.

No I say as I have now relisted it and I'm looking for my ebay fees refunded.

OK, he says he'll pay my fees but will not be happy if he get a non paying bidder strike.

My question,

Is this fair ?

Bear in mind that due to the poxy new rules, I can't neg him :bang:

He deserves a strike weather he pays my fees or not , yes ?
 
I take it he doesn't really want the car then? no chance of pay for it now and pick it up next Saturday?
 
I had a similar issue a few months ago for an MP3 player - not in the same league, value-wise, but the same thing in principal. If he has offered to pay your fees then I'd take that and let it be to be honest, even though I can understand that it's annoying to just let him get away with it. I got in touch with eBay regarding my non-payer and they were no help at all. I didn't even get all my fees back hence my advice above.

I'm not familiar with the 'new rules' though. You can't neg him as a non-paying bidder? Seems to be against the whole point of the feedback system really as he obviously didn't abide by the terms of the sale and should receive appropriate feedback.
 
If they don't pay the fees, then leaving a strike is the only way to get the listing fees back and that is if you file it within 45 days of the auction ending. If they don't respond to the strike, they will have any feedback they leave you retracted.

I think if I were in this situation with the current (stupid) eBay rules. I would get them to leave +ve feedback and cover the fees in exchange for not leaving a strike. It shouldn't have to be this way but I'd be very annoyed if they left -ve and not being able to much about it.
 
Get him to give you a payment via Paypal to cover your fees and a small non refundable deposit.

That should make sure he turns up next time.

Well, you have 2 options.

Either let ebay refund my listing fees, and receive a non paying bidder strike.

Or, pay my listing fees and I close the dispute without a strike.

I will not do either though, until you have left positive feedback for me as there is no error on my part here.

just a thought - positive feedback can be:

great ebayer bar far the best time waster I've never met...

payment of £0 in full and on time...

thanks for a complete and full waste of my time

thank you for saving me time by not paying, or attending, or buying

thank you for bidding if you could pay before 2009...



people do read feedback positive and negative, creative wording is the way to go with ebay's new feedback plan

Sold a Beetle ages ago on eBay, the guy never showed so I chased him for two weeks. In the end he gave me a £300 deposit [car was £350] which I explained held it for 7 days. He didn't show or contact me again for 14 days and I explained the car and his cash were gone.

Worked out ok for me in the end, I had double the money for the car :)

I thought you had to wait 10 days before you opened a dispute? Seems to me the whole eBay system is now geared toward protecting the frausters out there.

It was over 10 days h4rri !!

He won it on the 5th june, and told me on the 16th (yesterday) that he couldnt collect till the following saturday !!

Hes agreed to pay my listing fees now, we'll wait and see ?
 
ebay system is screwed up anyway, some wally bought some stuff off of me, didnt read the discription properly and then bitched like a kid cos he didnt like what he got. I didnt get the paypal lodged complaint email as it got spam-nuked, so ended up 'losing' so he got his money back, i got the items back, made him pay special delivery to send them back, sold them again for more money and to a happy customer, and ended up 'up' on the deal while doughball brain ended up out of pocket, with his 'mum' sending me emails...
