ebay issues

i hope this is in the right section....
i purchased an item off ebay back in september and there was a problem with it, i spoke to the seller he said no probs just return it and i'll refund you...
well you guessed, i never got a refund, the problem with ebay is that as i didn't pay by paypal (i'd recently had a fraud attempt via my paypal account for approx 6k) and i paid by cheque they could not help me, but they have clearly allowed this seller to carry on dealing and in my opinion dont give a toss about genuine honest members.
i have tried to contact this member many times since, the details he supplied to ebay ie: phone number etc do not seem to exist
i know this chap has had issues with the police as i reported this, and they told me that i would need to take this guy to small claims....
now the sum is only for £84 but to me it's the principle, i would never do this to anyone..
what would you do, has anyone had a similar experience ??

as soon as you leave the safety of PayPal you've pretty much given the seller the right to do what they want because its your word against his. The police don't give a stuff about small value frauds because the cost of pursuit far outweighs what you have lost in monetary terms, the only time they will really pay attention is fraud for high values or many cases of the same fraud. I think you just have think of it as a lesson learned not much else you can do if you can't track them.

As you returned the item you must have an address? Write your his home address asking where your refund is. Or pull his phone number and called him.

Have you reported it to eBay?

You are probly out of luck however there should be some way to track him down especially with the check the money transferred to or was cashed someplace eventually it would have to hit an active used account of his.. could see if your own bank might assist you

or turn up unannouced with three or four hairy mates (appropriately equiped for the baseball game they are about to attend) and say 'we want our money back ,innit"

Clearly not serious but you do have to pretty stupid to pull a fraud after giving someone your home address.
