Officially it only applies to business sellers. But eBay usually bends over backwards to be on the side of the buyer so I would think they may help you return for a refund.

No they don't, but as Ant said above, if you raise a case with eBay they may rule in your favour.

So for example, if the item is not as described then you will definitely win.
