1st question! Where are the preferences kept?
Why!
When I do a "save as" on a file and close it that is fine.
When I do the same on the next different file I get the error message "file left open or is open in a different app"
So I want to remove the prefs to see if this will fix the problem.
Or if you know of a different fix please tell.

To reset/delete preference hold down alt+ctrl+shift as soon as photoshop starts to load (it's actual location varies a bit with different os/versions) it'll create a new preference file.
Are you sure the file is not in use by another application?

The file your looking for is called something like "Adobe Photoshop X Prefs.psp) you might find it with a search for a .psp

Have you got an auto back up to another drive set up?
I get the same warning if I save when the back up is doing its thing.

What OS are you using Mac? try changing the name when saving as it may be a workaround.

Wayne, I use a PC & windose 7. I always change the file name when I save as.

Save it as a different name and you should be fine. Saving it with the same name of a different file that is already opened in photoshop will give the error. Eg. If you have 2 files opened in photoshop, one is named a.jpg and the other is b.jpg. If you are working on b.jpg and try to save it as a.jpg you will get error. Save it as c.jpg and you should be fine...
