I have not thought about this but a friend's wife just started taking photos for another professional. And this question of copyright came up.
If they are taking photos of motocross racing, the decals and badges on the bikes are (C) from the respective companies, they can' t be reproduced without permission. So her question was how can she print the photos when they show (or in some opinions reproduce the badges/decals) on the bikes.

I don't normally deal with that type of photography, so I did not have a great definitive answer.....
 
I may be wrong but I think you find its ok to print them its the actual decal that is copywritten so that you cannot make or reproduce the decal
 
You could ask the same question of any car or bike you have pictured, as I am sure that the names and badges of Ford, Honda, Suzuki, Mercedes, Ferrari, BMW, Porsche etc., etc. are all copyrighted, but it doesn't stop anyone taking photos of them and making prints.
 
It's the style and design of the logo that's copyrighted, as well as possibly a trademark.

It just affirms that that logo is the property of the copyright owner.
 
Because the image does not seek to reproduce the copyrighted works, it's fine to publish the images. This is called incidental inclusion of copyrighted works. This is under S. 31 of the Copyright, Designs and Patents Act 1988

If you took an image of the badge itself and nothing else, that may be a breach of copyright.
 
Thank you for all the comments. I will have to find the copyright statue for the US. I was trying to explain this to them but having it in writing is good.
