copyright question

Hi all not sure if this is the right place but I have recently taken some photos of athletes to give to the local newspaper and saved them on memory stick for them also on that stick was a photo of another athlete which was not to be used which I told the newspaper editor, but I know they have taken a copy of all the photos and knowing the newspaper I am sure they will use that photo which I said they could not as the person is a recent adition to the GB Athletics Junior team. I was just wondering where I stand on this issue if they were to use the photo.

Write to the relevant person and explain in writing that its not be used.

Or that the copyright is yours and that the fee for using it is £xxx.
