Hi All,

GarryP suggested I join and ask this quiestion here.

Somebody may know the answer to this.

I own the copyright to an image. It's one of the product photos on our website.

Now some lazy sod in the Ukraine is using this image on their website, and also on the bay and what's more important is that they are using our own image to directly compete with us here in the UK.

So the user is in the Ukraine, but their site is hosted in the UK, as are their listings on the bay.

Now I've sent the usual take-down request to them directly and their hosting provider. The image is still there

I've had some success with the bay getting to remove the offending listings, but now they seem reluctant to continue. Even after I sent the 'original' file to them with our exif data intact from time of creation in the camera! I think they are now dragging their heels as the next step in their procedure is to ban the user, which will obviously cost them revenue.

My question is...if I have no joy with getting this individual to stop stealing our property...there's no point in invoicing him in the Ukraine for the unathorised use...but can I invoice his hosting provider and the bay for every use at the going rate ?

Another avenue I might explore is to licence the copyright for the Ukraine to an associate and have them enforce it directly and locally to this thief!

Any help or advice will be greatly appreciated.

Cheers

Good luck on that one... other than through ebay you stand little chance of success.

A friend of mine had a similar situation where someone had stolen images from his (online shopping) website and was using them in ebay. He sent the criminal an email asking him to stop doing it... and it worked, but mainly because my friend is Ukrainian and has lots of big burly friends and family still in the Ukraine ;-)

Email he, telling him to take it down. God this sort of thing p's me off. I really don't see what people get out of it. I'd be interested to see your photo and his website.
Good luck

your best chance is wiht the uk host... one of the first ever recorded court cases was demon internet hosting some rather nasty posts about A to B and demon got done for hosting after they had been aware.. http://news.bbc.co.uk/1/hi/sci/tech/695596.stm

the host who are in fact hosting the copyright material have responsibilities

Hi All,

Thanks for the input so far.

Does anyone have a ready reckoner for going prices for images? I imagine it depends on the size and duration.

Also ref their web host and Ebay. Would charges apply for all copies of the image, i.e. small thumbnail and then full size? i.e. one charge for the thumbnail and another for the full size?

Hi All,

Sorry for all the questions, but is there an application available that I can use to check when an image was uploaded to a website?

Also any application or method to use to make a copy of the evidence? Screen capture?

Not sure if this is what you are looking for regarding screen capture.

Get the offending website up on your screen. Press Ctrl (control) and Prt Screen button (next to F12) That will take a copy of your screen. Next go to Start, Programs, then click on Accessories, then click on Paint. Once paint is open click paste, the page you have coppied should now appear on your screen. Re-size and save.

Hi Grayo,

That works a treat, thanks.

Now does anyone have any idea how I can check what date an image was uploaded to the offending website?

In the process of looking into this I've found another image they have stolen ;)

Sounds like the OP needs to ask you to get your friend to send another letter to this chap......

Well, maybe he can. He is in the "security" game now and used to be paratrooper :bat:

Maybe I can set something up for an introduction fee :naughty:

Hi Guys,

I'm taking advice from a legal company that deals in intellectual property. Will keep you updated.
