Somebody may know the answer to this.
I own the copyright to an image. It's one of the product photos on our website.
Now some lazy sod in the Ukraine is using this image on their website, and also on the bay and what's more important is that they are using our own image to directly compete with us here in the UK.
So the user is in the Ukraine, but their site is hosted in the UK, as are their listings on the bay.
Now I've sent the usual take-down request to them directly and their hosting provider. The image is still there
I've had some success with the bay getting to remove the offending listings, but now they seem reluctant to continue. Even after I sent the 'original' file to them with our exif data intact from time of creation in the camera! I think they are now dragging their heels as the next step in their procedure is to ban the user, which will obviously cost them revenue.
My question is...if I have no joy with getting this individual to stop stealing our property...there's no point in invoicing him in the Ukraine for the unathorised use...but can I invoice his hosting provider and the bay for every use at the going rate ?
Another avenue I might explore is to licence the copyright for the Ukraine to an associate and have them enforce it directly and locally to this thief!
