sadly its not simon that is wrong - this has been extensively covered in the photo press if you care to do your research.

you can only enforce an invoice in the small claims court if the invoice results from a contract -e.g if you did a wedding and the B&G refused to pay.

you can't enforce an invoice sent for copyright violation as no contract exists , and you can't enforce copyright violation itself because the small claims court doesnt do damages

as simon rightly notes , the appropriate route for copyright violation is the smallclaims track of the patents court.

so i refer you to your own post - people asking these questions need good advice, not incorrect advice - therefore they should listen to simon, not to the spurious advice you have posted here

Well just had an email back from the legal counsel of quicksilver-Europe , they have completely disavowed any responsibility. It’s not their company “it’s a completely independent company from our company”
So they allow an independent company to use their name. I find hard to believe. Here’s the email I received , is it me or does it sound like a crock of steaming horse meat.! As always guys your opinions are most welcome.
Dear Sir,
After further researches I noted that the reproduction of the picture was done by our Hungarian distributor, the company Krew Sport kft. Krew Sport kft is the company running the website www.dcshoes.hu.
It's a completely independant company from our company.
We have of course fowarded your email to the manager of said company named Peter Rath. You'll find below his contact:

Not all that uncommon. It's exactly how franchise are run for example. Take subway as a good one, all of their branches are operated by separate companies and I don't think they actually operate any themselves.

as neil says its not that unusual in franchised businesses - and i had a feeling it would go this way - wjhen you contact the hungarian distributor he will basically either ignore you completely, or claim its not an offence under hungarian law - secure in the knowledge that its unlikely you have a detailed knowledge of hungarian law, or the means to hire a hungarian lawyer to pursue this further

personally i'd file the whole thing under lifes too short, and forget about it
