I am about to make a claim for copyright theft against a publisher in the small claims court. The fees are'nt life changing at £150.00 but the issue has become one of principal as the I have been accused of holding them to ransom over my fees..

I intend to claim damages on top of my fees.

What I would like to know is how do you gauge the amount of damages to set ?

Has there been any additional costs to yourself? Any lost earnings due to chasing them? Any damage to your reputation?
 
Would the court work out a suitable sum if you asked them? if you give them details of costs etc.
 
Did they use your image(s) without permission in the first place?
 
The best advice I can offer is 'don't take the p*ss'. Don't ask for anything more than you're due and the court will look on you more favourably.
 
Simply add up all the time (££££) its taken you to get the money back.

At your normal and reasonable rate....don't be shy. :thumbs:

I lost a parking ticket case last year (quite a few actually) but one ticket in particular reckoned upon £550 for costs on a £40 parking ticket. :eek: (yes it went on a bit long, tail between legs etc)

I had no choice, I payed. :(

I had a scameraship take me to court (ok I asked to go) because I knew they were taking the mickey.

I won and asked for costs of £68.40. When asked how this was made up I relied "The same £60 they would have taken from me and three pints"
