Terms & Conditions of an online "competition", but I don't really understand

12.1 The copyright of an Entry submitted by You remains with You. All photographs uploaded to the Website shall be protected by the *** watermark.

12.2 In consideration of *** agreeing to accept your Entry, You hereby grant to **** a non-exclusive, irrevocable, perpetual, worldwide, sub-licensable, assignable, royalty-free right and license to use, store, display, publish, transmit, transfer, distribute, reproduce, create derivative works from or incorporate in other works in any form, media or technology now known or later developed, any photograph submitted by You, which forms part of the Entry, solely in the context of the Attempt, the Competitions and this Website.

12.3 In consideration of *** paying a reasonable fee (which will be agreed with You in advance and in good faith), You agree to allow *** to reproduce any Entry for any purpose unrelated to the Attempt or the Competitions.

12.4 Where an image is reproduced by ***, the photographer will be credited.

12.5 If You select to sell your photographs through the Website in the future, *** shall pay You a royalty fee of between 70% and 80% of the value of the photograph.

12.2 is the bit I don't really get!

:help: & Thanks :)

you enter the comp, we pretty much own the image

dod's slightly wrong.

It's "You enter the competition...you still own the image.....but we can do whatever the hell we like with it".
BUT I think they can only use it "solely in the context of the Attempt, the Competitions and this Website.", which is a bit of a wide scope. But it means they cant sell it as a print in its own right, or use it for some other random ad campaign not relating to the comp or the website.

dod's slightly wrong.

Right enough, I misread the bit on context :)

I'd be a bit concerned about this clause too though ;)

15. AMENDMENT OF TERMS

15.1 XXX reserves the right to amend and edit these Terms from time to time, and without your prior consent.

15.2 It is your responsibility to revisit this page from time to time to re-read this notice. Any revised Terms shall take effect as at the date of their posting.

XXX is taking the XXXXXXX XXXX.

imho :D

Pass the barge pole

I would imagine that, by submitting your entry, you are agreeing to the terms and conditions. That means that, regardless of when they change the terms and conditions, it does not affect the contract you have made with them at the point you entered the competition, at least for that single entry into it. If they do decide to change them later, then I believe it would only affect subsequent entries.

I could be wrong of course, but I'm fairly sure that's the situation. Feel free to correct me :)
