I've gone and done it - albeit I only found out that I have by a bit of a fluke....

I tend to mostly keep up with speedway news via the internet. During the season I probably buy the weekly "Speedway Star" Magazine about a third of the time, and during the winter - I only pick it up if I happen to be near a WHSmiths that have it on the shelf. By coincidence today whilst out working I needed a pee, so popped into Tescos to use their loos. On leaving again I had to walk past the magazine stand so thought I'd see if they had the new Digital SLR mag that folk on here have talked about. They hadn't, but I did by chance notice a copy of the Speedway Star, so picked that up, paid for it, and left. Browsing through it on getting back here I discover an article about our meeting presenter at Ipswich - and think "Hmmm...that bottom picture looks a bit familiar" - sure enough - it's one I took of Kevin at the British Grand Prix earlier in the year. Well, fair enough, I sent a copy to Kevin without making any stipulation on what he can do with it so, well, a credit would've been nice but, hey ho, at least I've got a shot in.
I've just been going through some shots with a view to updating the speedway content on my site, and lo and behold, what do I discover but the OTHER shot in the article is also mine! This is where it gets interesting though. I only have one processed version of that shot. It's gone on my website (I think - although I've yet to check that) and also in my webshots album which is linked to severasl speedway websites. It is copyrighted clearly in the bottom left hand corner! The magazine - on producing it - have cropped off that bottom edge to remove my copyright! Cheeky blighters!

I shall, this evening, be asking the other half to assist me in writing a legally worded letter asking for payment and a credit in next weeks mag!

(But I'm still chuffed they've printed them though - it's a right closed shop normally!) :D

Congrats, but I can see why you are p***ed off, please let us know what happens. I can only imagine what it must be like to see your photos in print must by a great feeling.

Nice to get in print but very cheeky of them. You could turn it around and try and get some future work from them with the associated fee and in the process let them know they have crossed the copyright line!
 
I have just had this problem with a website using one of my photo's without permission. I think a fimly worded letter explaining how copyright works is needed. Hope it works out for you.

Congrat's on getting them published.

Make sure they pay a fee and get compensation for breech of copyright.

While Im wanting to congratulate you, I also feel a bit p*ssed on your behalf at the nerve of the mag.
I know how exciting it is the first time you see your pics in print but that soon wears off after a while... however, the bitter taste of no payment or recogintion doesnt wear off quite so quickly.
Id get that letter sent pronto.
...Oh b****r it ... congrats on having images worthy of theft! ;) :lol:

And good luck in sorting the dosh 'n credits ... bloody nerve I say ...get 'em sorted otherwise they'll carry on stealing stuff ...:thumbs:

shame they had to steal your work to fill their pages, but at least it was good enough :thumbs:
 
I've done a bit more digging on this - it seems that the person the article was about provided the pics. Helpful of him eh?! I think they are still likely to be paying me though. :D

Completely illegal - you have them bang to rights - sue the conkers off them. Don't just accept an apology and an offer to pay the normal repro fee.

On the plus side, you are now a Professional Photographer. Congrats.

Congrats on being published. My local rag (about two years ago) printed one of my pics of my son's band, that they had clearly lifted off his website. So proud they had bothered, I never said anything..... Didn't realise I could, back then. Much more savvy now, thanks to this forum. :D
 
A letter has gone to them today demanding payment, costs, and a credit in the next issue......from my other half's firm, so that should get them hopping when they get it on Monday! ;)

I'm still smarting a little over the fact that. whatever they now pay, my first shots published in there WILL have gone in with no credit.....not really any getting round that now. I'll keep you all informed of developments anyway!
 
Its rather cool that you got published. Not the best circumstances though.

I have to admit that. at various times through the day, I've suddenly found myself grinning inanely as the thought filters through my head "I've had my work printed in a National Mag!" :lol:

Congrats on getting published. I bet they'll be in for a shock when they open the solicitors letter :lol: Serves them bloody right. Hope you get sorted with a nice payment and get the recognition you deserve!

Hope you get a nice fat cheque and just as important, the proper credit in next weeks issue.

As for the shot of Kevin, I think it's understandable they used that shot, as it came from him, himself. He should really have clarified with you first before sending it on, but hey ho, I suppose that one can be put down to experience.

As for the other shot...like Arkady says, bang to rights, and congrats...you are now officially a pro :thumbs:

I've had a couple of shots used in publications before now, only small things, but it really is a good feeling.

They've come back - claiming that they didn't cut my copyright off.....well, they WOULD claim that, wouldn't they! They've immediately said they'll pay me the going rate which is fair enough......Ben's doing a follow up letter pointing out that regardless of the copyright being removed, they shouldn't have used the pic without being sure they had permission anyhow!

Hopefully I should yet get my credit too......:D

The plan is that next season I'll submit stuff regularly and see how I go. You never know....! :D So far the last couple of years I've achieved my aim of firstly getting my shots used on the website, then getting more centre green access and finally getting stuff regularly printed in the match programme......I guess a few more shots in the Speedway Star should be NEXT season's aim then?!
