Can anyone tell me the name of it please and is there anything wrong with it? There's black spots all over the leaves.











 
It looks like photinia which is a shrub not a tree, and by the wilted look on the leaves and the black patches, I'd say it does have a problem.
 
I just Googled and apparently they are prone to leaf mould.
 
The tree I believe is Photinia × fraseri 'Red Robin'. The spots could be stress due to a bit of cold wind or frost damage. They generally prefer a sheltered position, damaged leaves usually fall off. Now is a good time to give it a feed, which would help it recover. I would be tempted to cut a small circle around the base and feed within that with - a growmore type fertiliser.
