Just had this via flickr mail...

Hi

i am working for SAVE Britain's Heritage doing photo research for a book to celebrate the charity's 40th anniversary in September. St James Church Cheltenham will be included and I'd like to use your photo which you list as Creative Commons, so we can presumably do this without paying a fee. We would like to credit you though so could you tell me your full name please?

You didn't state that in your 1st post. Get back onto them and explain it's non commercial

They probably saw the Creatives Commons bit and jump to a conclusion.

Not everyone will be as aware of the intricacies of copyright law as most on here, even if they ought to be, when asking for use. No doubt you will get the 'we are only a lowly charity' bit next. They have some luminaries and even people I know in their trustees list, but that means nothing. Just go back and tell them that you don't allow commercial use of your images and see what they say. If it means something to them, they might find their way to recompensing you to allow commercial usage.
 
If it really is Save Britain's Heritage then I personally would say yes without requiring recompense. They're a worthy charity imo and i would be happy to support them by allowing them to use one of my photos.

Can you not restrict third party usage on Flickr?

Surely basic copyright law still stands regardless?
 
I mailed back and pointed out that Creative Commons does not necessarily mean free and that if the book is to be "sold" then this makes it a commercial proposition.

I've asked for a reply, even if it's a "no, we've got no money to even offer you some small recompense"....
 
Surley it shouldn't be too difficult to find out if the project is real or not, if it is then you just have to decide what your prepared to settle for :)
