I attended a gig in London given by Kasim Sulton (google the name if you are unsure) and he is the bassist to Meatloaf and also his musical director. Whilst I was there I shot some pictures off and have just been sent a link to his new website selling merchandise. And what do I see on it, one of my pictures that was sent directly to him. Not one opf the best but he wanted it quickly and without P&P. The picture can be seen here:

So what do I do now in order to keep the rights to the picture etc??

I dont mind them using it but to try and sell something without giving myself due recognition has annoyed me a little bit.
 
Why did you send the picture to him?

Maybe he thought you had given it to him? It seems to me that the picture will be used on a card for the gift voucher.
 
Bit silly sending a pic without explaining the licensing behind it.

Email him, say you are over the moon that out of all the photos he's had taken that he chose your one to be best of the bunch for inclusion. Explain your normal rates are XXX but since you are a fan you'd be happy to grant him permission to use it on the gift certificates for some CD's and t-shirts and a photo credit.

Dont march in all guns blazing, it never works out well and he'll just remove the pic and use someones elses.
 
He asked for a copy as he wanted one for his own album. At the time when we were discussing it it was made clear that it was not to be published and if he wanted to use it on a website that I would have the opportunity to P&P it and get full accreditiation.
 
Aha, you didnt fully explain what you did. I read what you wrote as you just emailed it to him quickly.

In that case I'd contact him quoting the email in which you stated not to use it for commercial purposes and ask for payment or its removal.
 
Alternatively.... wait a little longer until he has had the gift cards printed... THEN ask for recompense ;)
