A Cautionary Tale :D

I sold my second image this week but not without some tension…read on if you will....:)

I got an e-mail on flickr!

Dear Dark Star,
I would like to use this photo (of yours) 3232743980_d200df0652_o (kitchen timer - hen), for a print ad. Is that OK with you? If yes can you provide us the image in higher resolution?


Hmmm....my response was:

Can you send me more detail of how and where this will be used?

To which they responded:

Thank you very much for the immediate response!
We would like to use your photo for a print ad size 21x28 witch we will post in 4 Greek magazines.


So another quick interchange with some qs and as led to this:

1) What will you use the image to advertise? We will advertise one of our shows with subject: cooking

2) Which magazines will the image appear in? greek Tv-program magazines

3) What are you prepared to pay for the use of the image? for all the images we have used from flickr.com, we have never paid before

4) Is there a problem with me retaining copyright of the image? Absolutely not - you have the copyright of the image - do you want

Aha so I replied:

I feel that if my image is used in an advertising campaign for a commercial TV program (for which budgets are normally allocated) then there should at least be some remuneration for myself.

As pleased as I am to have my image selected I would be happy for you to use it only if we could agree a suitable fee

Please let me know what you would be prepared to offer for its use

Many thanks

And they replied:

Dear John,
Normally what we pay for such images is 100euro one off.
If you agree we can procceed, otherwise name a price and we will answer if we can pay you the fee.

So I said:

Thanks Alexandra – I would be happy with a one off payment of 250 euros for the use of the image in 4 magazines
Can you agree to that?

And they said:

Dear John,
since we have never before paid for the use of a picture from flickr.com, the best offer that we can make is 180,00EURO. Can we agree on that?

And I said:

Its a deal :D

And then it went very quiet for a few days…."b****r I’ve blown it" I thought :shrug: ….then today….

….we have an approval from our company for “buying” the photo we have discussed.

Here’s how we should proceed.

In order to pay you the 180€ agreed....

Whoopeee :banana:

From 0 to 100 Euros to 180 Euros in 2 bounces :thumbs:

And the image in question?

Of all my arty farty and 'clever' shots its this one :lol::lol::lol:

Well I won't celebrate too much until the money is in my account but it has felt good getting this far - and my thanks go to Janice and Pat for some moral support during the bidding stage

Moral of the story - hold out :D

I gotta echo what's already been said, well done.
The amount isn't important, the way the deal was conducted is.
Its not difficult as your correspondence displays, why can't everyone make the same kind of effort, not to devalue their work with credits only as payment.
Flickr really is a complete hell hole for this, the more peeps that stick it out for a reasonable deal the quicker the message will be received that images just aren't a free for all.

Get that...."we never paid for Flickr images before", whaaat ! :shake:

Although if I read your post correctly they said they never paid for images and then later said they NEVER PAID MORE THAN 100euro....:suspect:

They didn't say they never paid more than 100euro for a Flickr image, they probably buy lots of images from different places but usually only get free ones from Flickr.
Whichever way you cut it, you're right, they told a few porkpies to try get the best deal, business is business, if the Flickr shooters behaved in the same way when selling images, we'd all be a lot better off.
 
Thanks for the replies folks :) As I say the money is not in the bank yet so maybe this is premature congratulations :) ;) But I'd be much more confident in pushing back next time :)

Nice one John, always amazes me how some people see things, like you say it is a simple shot and they know to get an image off of one of the stock sites would have cost a lot more. :thumbs:

do they want picture before payment?

And the details are sorted, invoice sent, access to picture granted - I have their company details should things go pearshaped so I'm fairly comfy with the arrangement (despite being a complete novice :gag:)

Not that the shot isn't good, but it often goes to show that making dosh from photography isn't always about being a great photographer, but more about being a great businessman ;)
