Here is the situation! A mate of mine ordered an iPad mini 128gb from Currys, he's going travelling for 18 months next week. The iPad didn't turn up on time so he complained to Currys and they sent him a replacement. Today a courier turned up with the original which he has signed for so now he has two iPads but only paid for one! What would you do? He's saying he wants to sell one but I said they may come knocking for it.
 
there is an obvious answer as to what your mate should do.
 
I think he should send it back otherwise may get charged for two anyway.
 
Since when did the 2nd become his to sell?
 
The decent and honest thing to do is to inform Currys and return one unopened and unused.

Whether your friend is decent and honest, nobody on here knows.
 
I would keep it for now, their mistake, and return only if requested.
 
So Currys played a blinder shipping him a second one just because of a slow delivery and your mate now wants to rip them off?
 
I can't believe your "friend" is even thinking that it's rightfully his to sell.
 
Write to them.
Tell them the extra Ipad is theirs to collect for 14 days and that after that it will be disposed of.
Then it's their choice.

I told him myself to get in touch but it's hard to convince a 24 year old who is short of cash to do the right thing!!

I believe it's actual theft ;) There's such a thing as theft by finding where you don't take steps to find the owner. In this case, the OP's "friend" knows who the owner is.
 
My lad ordered some items from Amazon, instead of his microphone they sent him a Canon 50mm f1.8 lens.
He's contacted them, saying his item was included, theres been a picking mistake and could he have a returns label and his item sent.
Amazon have said they won't send the item until they have the lens returned and checked which will take about a week. Pretty poor for their mistake and my son being honest.
 
If it was me, I'd tell them to cancel my initial order, then ask what they want you to do with the lens they wrongly delivered (unsolicited?)
It might have the desired effect.

wowsers my experiences with Amazon are nothing like that, I get refunds before I even send the item back, I reckon if that would have happened to me it would be like when I have a faulty product, they send one next day and then I have to send the other back within the next 30 days.

your case is poor for what I have experienced with Amazon. was it direct from Amazon or a 'fulfilled by'?

I'm sure @Lynton would email the CEO and complain, you never know he might just say sorry for the inconvenience,
its not worth our while collecting it ;)

They need to write to Curry's telling them of the mistake and inviting them to come and collect the second iPad at there expense, he would need to give them at least 14 days in which to do this - He should send the letter via recorded delivery

Should the 14 days expire and he gets no response from Curry's he then needs to write to them a second time giving them notice that he intends to dispose of the iPad, he needs to give them a period of time to respond to this second letter (14 Days) - He should send the latter by recorded delivery

After doing the above he has covered himself

Agree, otherwise knowing he has had it delivered and has assumed ownership of the item knowing he has no right (ie not paying for it) and intends to deprive (sell the item) the rightful owner of it, then theft would have been committed.

Email isn't acceptable either as you have no proof of receipt.
 
What loads of BS the above letter rubbish assumes he has made some kind of contact and has not had any action.

According to the OP he hasn't made any form of even initial contact, he should in the first instance call someone and advise them of the situation, then if there is no action he can follow the letter route.

You missed off mentioning the fact that even if he sells the iPad the money from the sale isn't his and he has to then send the proceeds to Currys.

What happens to the money from the sale?
If you know the address of the owner of the goods
You must send them the money from the sale. You must also be able to show you got a fair price for the goods.

If you don’t know the address of the owner of the goods
You should keep the money until six years have passed. At this point, the owner of the goods has lost their legal rights to take action to get their money or the goods back.

Probably easier to just do the honest thing and just return the iPad to Currys.

Hope he's living with his parents or some trustworthy mates who will be there when Curry's knock the door wanting it back
 
End of the day, 2 items have been delivered, 2 signed for.
When Currys realise, ( and they will ), they will simply take payment for the outstanding amount from the card used to purchase the first.
They have the signature as proof of taking possession and no one has contacted them to say that the remaining ipad is unwanted.

Can't really see how either of these apply here, the goods were not delivered by mistake or left behind, they were a replacement for something
lost in transit and the 2nd was sent in response to a request from the purchaser.
Curry's may have started a claim against the courier, but as they have proof that both items have now been delivered it's unlikely that will go beyond
refund of delivery cost, the onus is still on the recipient to pay for or return the item
 
hmmm - but if 'your friend' is going away for 18 months this needed to be sorted out NOW before he goes
 
My guess is that this travelling friend will find himself with a lot less money on his card than he's expecting within 28 days :lol:

Their mistake not the guys mistake, why should he be inconvenienced and have to pay expenses to return it. He has enough on his plate sorting out wherever he's going for 18 months. Doubt they would take a unauthorised payment from his credit card, he made one order, they delivered two.

He signed for 2, thereby legally taking possession of both.
He has given them no indication of any intent to return the 'unwanted' ipad.
They are within their rights to apply the charge for the second one.

If he simply returns the item that is not legally his, everyone wins.
He can even return it to any Currys/PC World.

Why should he? Because it's the right thing to do.
