Watermarking problems in photoshop

Been playing around with photoshop elements 7 and trying to watermark my pictures.

This is what i want my watermark to look like.

But on some of my pics it does this ( really small writing in bottom left)

and even randomly puts the watermark in black and white/grey too.

Anyone know why and how i could stop this from happening? it's really quite annoying :bang:

How are you watermarking? with an action? if it is the size difference is because you started with different size pics (most lightly) I have a step in my watermarking action that resizes to a set size (I use a 1000 pix) as an early step so your starting with all the pics the same size before you add the text, then resize down from there.
the b+w text is I guess because the image was converted to b+w after the watermark was added.
