Dua Lipa is being sued by Integral Images are seeking £108,000 damages after the "star" apparently used one of its photographs on her Instagram account.

At a guess, the positive publicity she could get for holding her hands up and paying would be worth every penny of the $150,000, especially when looking at the potential adverse publicity going to court might attract.

Having said that, it looks like the copyright was granted (IIRC, US copyright laws are different - not sure how different though!) well after she used the shot.
 
<controversial>If this were France, she could probably sue the paparazzo for taking and publishing the shot in the first place. Hardworking photographer being denied the income from their creative work, or parasitic, privacy invading copyright troll doubly exploiting another artist? Perhaps we need a law somewhere in between - everyone is fair game, but if an image is taken without your permission, you can re-use it as you see fit... Incidentally, has everyone on TP who is using third party artwork as their avatar image cleared it for copyright?</controversial>

Just had a quick look at the site of the US copyright office - it looks like copyright is automatic on creation of the work, but you need to register before you can take legal action against someone over it.

Probably not. Maisie did sign a model release for mine though - well, she sat on plenty of paper!!!

Copyright exists on creation, however registration allows for the claiming of statutory damages (rather than just actual damages) which is up to, unsurprisingly, $150.000.

There's something wrong in the world where somebody can be sued for hundreds of thousands for using a picture but if you get injured in a car crash but not crippled for life you're lucky if you see 5k

My sympathies are with Dua Lipa - She has done no wrong in my eyes. Anyway, I am a huge fan. :love:
