Awhile ago we put a bid in on a house ( house A) simple enough!
The estate agent, I will call him "Lee" the same agents that are selling ours
( after being chased) said " the seller wouldn't accept a bid from us even at £xxxxxx ( £40,000 yes thats right, over the asking price) as we were not in a strong position
( our house wasn't sold at that point)
A few days later our house was sold, I went to see the agents to find out if they had re-submitted our offer to which they said no as there might be a problem with the chain below us,.
Fair enough.
We then found a better house ( house B) different agents at roughly the same price and the sellers said that
they would wait 4 weeks before re-marketing to give us a chance to complete.

I found out by accident ( yet again) that the people buying our house have now resold with a completed chain behind them Wahooooo!

The agent then said its looking good for you to complete with house A To which I said according to the web site its under offer and repeated back what I was told originally, "not accepting an offer from us at any price".
"Lee" then said Well They didn't actually say that !
He then said " the under offer" is from you, well I did get a little "irritated" at that point and told him he had no right.
I won't type the rest of the conversation as it was a little heated :bang:

The people buying out house are making "noises about a "serious reduction" in price as they dropped theirs by £20,000 ( which BTW brings it in line with properties of that type and that area)
They came for a second viewing Saturday and said nothing to me about another price drop ( they have already had one)
And are still keen to move "here"
I asked "Lee" for an up-date to inform the other agents ( for house B) and he said that it would be Monday before he had a definite answer as a couple of the agents involved in the chain don't open on a Sunday! An estate agent thats closed on a Sunday? I doubt it not around these parts!
If that little scrote "Lee" has agreed on our behalf a further £10,000 price reduction I feel a law suit looming :rules:

Monday will be the telling time but as is said in every star wars films "I have a bad feeling about this!"

This is the abridged version and there is more to this than that But I didn't want to keep you awake all night reading :D

EEks that is really rough. As first time buyers we didn't have any issues but I'm not looking forward to next time! Hope it all works out ok for you.
 
Got to say I hate the idea of these "chain" things. Much prefer the way it's done up here where the solicitor puts in an offer, it gets accepted, deal done.

Having just gone through all that this week I couldn't agree more.

Theres a lot to be said for the Scottish "method" they are ( have been) trying to impliment something like that down south, but I doubt it will ever happen
 
It sounds to me like "Lee" is being a little out of order here and needs reporting to the estate agents ombudsman (I'm sure they have one). They work on commission, so it sounds like he is trying to milk it.
 
Although the Irish system is similar to that in England we tend not to have problems with 'chains'. It's not a term we hear. There's no doubt that the Scots have the best method. Incidentally I wonder if your Lee is a member of a professional body as they should have standards/ethics and means of bringing errant members to heel.
 
The Scottish system has great benefits for both parties once the offer has been accepted however up to that point it's vastly weighted in favour of the seller. As a buyer unless you are the only person interested in a property then the seller isn't going to discuss figures with you so you really are flying blind when it comes to making an offer. All you can do is put a figure on the offer and hope it's a) big enough to secure the property and b) small enough to only just secure the property.

It does work both ways if you have somewhere to sell but only if what you already own is a property which is in demand.

We bought this house when we got married some years ago and not moved since, though we did try a few years back and got so p'eed off with estate agents that we stayed and put and extention on, sadly we have now out grown this house as the two "kids" show no signs of leaving home we need a bigger one.

Just wait until you have an estate agent try and tell you what is, and isn't, a good photograph!

I think I've bled from my ears a couple of times from trying to keep the expletives contained!

The only one who has any kudos with me used to be a BBC cameraman and understand lighting and the such perfectly.

The worst ones are the ones where somebody in the office has bought a dSLR and thinks because they have 'pro' kit they are now ansel f'in adams. ARGH!!!!!!!

Some of the photo's I have seen on the website and prited material leave me cold! Even I can see the blown highlights and distorted angles ( not just the ones used to con the buyers either :D)...............

UPDATE having had the p1$$ taken outta me ( us) over the last few weeks with "dishonest" dealings and offers made on out belhalf and the buyer of our property trying to beat us down to an unrealistic price it looks as though we are all systems go! unless the F'wit previously mentioned manages to completely screw up the transaction because I didn't buy the house he had put an offer in for ( one they are selling) that I didn't ask him to!

We were on the verge of taking our house off of the market because I ( we ) were completely and utterly and totally f'ed off with it all. Tommorow is another day!

Well a deal has been struck so its over to the solicitors to testicle it all up now for a hughly inflated price! :rules:
Can you believe our moving costs ( stamp duty et all) will be higher than the actual purchase price of the house we currently live in? :bang: and NO we haven't bought Windsor castle ( its to friggin' small :D)

Funny thing is that even beore I read your story, I thought to myself, now what would I call the most unprofessional profession and without even opening up the thread Estate Agents was top of the pile. I'm sure it is for allot of people as well. Can't believe how little regulation runs these people.
 
i'm guessing he bought the house 20 years ago for about 80p and has enjoyed a great many years with a small mortgage.

More years than that DF and all those years ago it was still a real struggle to pay the mortgage.
I really feel for youngsters today I would hate to be starting out now, I guess its all relative though

(all except one fab agent in Northampton, who were ACE right from the start! :thumbs: so I bought a house from them)

My solicitor was ok tho! :D so no need for the bat there!!!!! :D :D :D
 
when i bought a house i got a little fed up with estate agents, firstly there was the one that phoned me up the day after i viewed a house that the previous night the beck behind it had burst its banks and shat quite a bit of water through the back door.... she asked me what i thought of the property - "well it was alot smaller than the pictures made it out to be, far too small infact for me to live in comfortably, oh and whilst the added touch of the swimming pool was quite nice its position in the kitchen was somewhat lethal" she then said "would you like to put an offer in on this property?" to which i replied "does it sound like it...?


the other one that annoyed me was the estate agent that didnt seem to understand that we were putting one offer in on the house and we wanted an answer back ASAP on whether it was accepted or declined by the seller (who had previously said he would accept the offer we were putting in) when 4 days later they still hadnt contacted me we phoned up and removed our offer.
stupid stupid people, i cant wait to have to deal with them when i sell my house!

An indoor swimming pool would be nice but in that instance I guess the location was a tad off putting :D
I agree also about trying to get an answer they are paid quite well ;) for what they do, and it makes a mockery of the whole thing when they can't be bothered to communicate and "you" have to chase them all the time

I can't ( well actually I can) believe that almost a year has passed and we are still trying to move
That F'kwit Lee is no longer with the company that caused us all the troubles
However his replacement is just a big an ass hole as he was though.
We have been let down and ill advised by that same company for several months,
Now more recently we have instructed new agents ( twice) but with the falling property market things have remained fairly stagnant until now.
We have had an offer on our property through agent #3 quite recently, which we have accepted.
Our buyers, buyer, is a cash buyer ( proven beyond doubt) and the chain is short, 4 in total.

#1 estate agent, whom I told to F'koff ( literally) several months ago following
" another episode" in a long line of unprofessional dealings and lies,
now are trying to claim their fee if my property is sold on this occasion,
as the prospective buyer initially viewed through them a few ( several 10 or so) months ago.
How they found out I have no idea.

They have tried badgering the prospective buyer & me, even threatening me with legal action to recover their fee should this sale complete.

I have counter threatened them with harresment unprofessional tactics and costs
( escalating legal fees and survey fees from failed sales due to their incompetance.

Our buyers buyer, are on a tight schedule and want to move to this area
( for personal reasons) before the end of August.
I can see #1 estate agents ( who our buyers have sold through) screwing this up yet again, in which case
they will have no fees paid at all but they are so bloody stupid I doubt that has occurred to them.

I have sort legal litigation advice and am waiting on a reply.............

I've heard it's cheaper to have peoples legs adjusted than use a lawyer, don't look in the yellow pages, you'll find them in the local pub ;)

The market is dire at the moment though, I have given up with trying to sell mine and I have a lovely tennant for it instead who (hopefully) will be in a position to buy in a few years time.

Hope things progress rather more smoothly for you from now on.

Cheers Susie, the market is dire but at least us at the top have all agreed to drop our prices as the market has been falling so pro rata no-one loses out

I believe the rep for the first EA has a legal obligation to pass on your offers. Even if he's not working there anymore he was still representing the EA at the time.

We've got our place under offer again. Had to drop the price a further £20k. Our chain is short, only 3 including us and our buyers buyer is a cash buyer. I have a good feeling about it this time.

Im very confused-why would they not have a chain in scotland even though its structured differently. if the people below you are waiting to sell their house and you cant move until they have then its a chain right.
 
I beleive that the scottish system is once you have made an offer that has been accepted your are fully comitted
and there is no way out ( any input from someone North of the boarder?)
As to the chain then yes there must be one
