I was bored a few nights ago so i was doing a reverse image search on some of my photos that are on Flickr. I came across a heart shadow shot that i did for valentines day on a site called We heart it (a bit like pinterest, Tumblr etc). All the versions of it on there linked back to a Flickr account.....which wasn't mine :nono:

I contacted Yahoo and have now been told that the offending photo has now been removed from this person's photostream. But that doesn't change the fact that my image is floating about on the web with someone else's credit

The person who stole my image had stripped the exif info and uploaded it to Flickr as their own, ©All rights reserved. Blooming cheek

Not being funny here, but are you 100% positive it was yours? Because every single one of those heart/ring/shadow on a book shots looks identical to me. Was there anything instantly distinguishable about it? One look at that site and it seems all very random. People uploading screen grabs from movies, drawings, text quotes ... nothing seems very original.

Yep, 100% sure. Mine has 3 distinct hearts within each other, in a certain place in a certain book. I've never seen another one with 3 hearts, let alone done in the same place in the same book.

If that wasn't enough, it was shot with my wedding ring, and if you look closely you can see the number 23 engraved inside the ring, the beginning of my wedding date ;)

That's pretty definitive alright!

The problem with sites like that one is you need to look into their TOS, they may have it somewhere in small print that they are free to use your images, once uploaded, anyway they please.

Thanks guys :) Found out they had a dedicated button to report copyright infringement, so i reported it. Have had an email today to say they have removed it from their server.

Slightly worrying though, they have said that they have notified the person who originally uploaded it and if that person disputes it they will allow it back on the site again. In which case they will only remove it if i start court proceedings  Surely as i can prove i have the original RAW file etc that wouldn't be necessary? Not that i expect the person who uploaded it to try it on, but you never know!

Put yourself in their shoes.

if 2 people claim to own copyright for an image, it's for the courts to decide, would you want to attempt arbitration? They have nothing to gain from getting involved, the law is on your side so you'd have to use it.
