Hello everybody

We’re looking for photographers to add their pictures to our new Wake Up Gallery on Magic FM.

The theme of the gallery is early morning experiences. This could be anything from your baby’s first smile of the day to an arty close-up of your croissants. Or from a beautiful misty morning view to your cat having a big old stretch.

Do you have any early morning photos you’d like to share? Upload them to the Wake Up Gallery by going to REMOVED, SEE BELOW. Please tell us briefly about the picture and let us know your favourite ‘wake up tune’ for Neil Fox to play on air, on London’s most-listened to radio station.

I hope you don’t mind me dropping by your forum to tell you about this – I thought it might be a fun project for keen photographers such as yourselves. Thanks!

Sue Keogh, Magic FM

I don't normally jump on the terms and conditions bandwagon but those for this 'gallery' are exceptionally bad!

3.6 You acknowledge and agree that, if your Submission is chosen (as defined in Rule 4 below), that you will execute the necessary documentation to ensure you will have irrevocably assigned and transferred to Magic any and all rights, title and interest in Submission, including, without limitation, all copyrights, and that you waive all moral rights in your Submission.

and thats just a taster.

Early morning?

I'm unsure what you mean by this.

Hahahahah! Oh god, that's a good one! :bonk:

And how much will Magic FM be paying for the pleasure of our executing "documentation to ensure you will have irrevocably assigned and transferred to Magic any and all rights, title and interest in Submission, including, without limitation, all copyrights, and that you waive all moral rights in your Submission."?

3.4 You irrevocably grant to Magic, the relevant Parties and their affiliates, the unconditional and perpetual right and permission to copyright, reproduce, encode, store, copy, transmit, publish, broadcast, display, publicly perform, adapt and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Participant's Submission in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party.

The first thing we look for when someone posts a 'competition' is A : What's the prize, B : Is it good for the members, C : Will the poster be making a profit from the entrants (IE is it commercial activity), and D : Check the terms and conditions

Allow me to redress

A : There isn't one
B : Er not really
C : Use our forum as a medium to drive traffic to your website/venture. I think it would only be fair if we were given some free on air time in return.
D : See above. Very strict rights grabbing terms and conditions, and we refuse to promote those on here. As a forum I like to believe we act in the interests of photographers, and by refusing to give any publicity to ventures carrying such rights-stealing conditions, I think we're doing our bit.

LOL

Well spotted, it looks like quite a few people have already given their artwork away though. This is a good reminder to always read the small print, or even just read the print. Sneaky, hope someone challenges them about it, especially after the facebook court hearing.

I missed something there, what was the Facebook court hearing and what happened?
