Online newspaper using my photo

Noticed on Flickr a picture of mine (False Widow Spider) had a few hits lately so followed it back and it seems The Daily Star (online) have displayed the photo, rotated it and used it as part of a story.

First off you should not be stating that and especialy not in print like this.. You ahve no idea who copied your picture.. anyone could have done it then submitted it to the daily star

Next.. get in touch with the daily star and in a nice friendly way.. ask them where the picture came from while informing them its yours and copyright..

This is presuming you ahve all the right flikr boxes ticked and you ahvent auto given permission for anyone to use your pics:)

The other FWS shot is also a cropped, and rotated/flipped version of an online image. You can see it here.

The degree of modification to both of the images suggests that someone knew that they were doing wrong and has attempted to prevent image searches from picking it up. As above, you need to determine who - whilst the newspaper takes ultimate responsibility for the act of publishing they may have been mislead. Mind you, if it was me I would be looking for recompense from the newspaper regardless of how it happened.

Nobody is suggesting he doesnt do that.. but theres a way.. and step one is to find out whats gone on.... not to just jump in with an invoice.
 
Aye, I'd read you said that - so I didn't think to repeat it. And yours is the approach that has worked for me in the past when something similar has happened to an image of mine. Although mine was a more blatant offender with regular "form".

But I would recommend not playing it too soft at the start. It needs to be very clear that although you're asking about how it happened, there's no question that it has happened, and regardless of how it happened the only question you need the answer to is where to send the invoice and who it should be for the attention of.

Above all, don't even suggest that anything other than a paid invoice will make you happy - belated credit on the article is worth nothing.

checked privacy and permissions with no luck!

I think he means to check if you have the image set to Creative Commons allowing any use, including commercial. Best to stick with all rights reserved on Flickr. Too many view it as a free source as it is, without giving them the wiggle room of confusion over CC.
