Non Payment for Item from TP Member - Where do i go now?

Sold a set of portable studio lights to a TP member a couple of months ago.
Payment as agreed was to be at the end of that month.
He contacted me saying he was being made redundant and couldnt pay that month (July). I told him i wasnt in a hurry for the funds.
At the end of July i pm'ed him to see if we were any further forward and he asked for my paypal address as he had sold a few items and would make payment.
Several weeks, numerous pm's, phone calls and nothing.
He seems now to be totally ignoring me.
Whats steps are open to me?

Just to clarify - have you actually sent the goods or were you awaiting payment before sending?

Edit to say - you should probably check directly with a mod as to whether there is any kind of formal procedure in this situation.

Did you get any further details as per the classifieds guidelines?
If so, that means you will have his home address and a landline phone number.
Please use the Contact Us facility with all details, including if you can a chronological frame of whats happened (with dates), give us a clearer picture.

Your advert says sold pending pick-up did you meet this person:thinking:
 
have you actualy sent the goods.?
if not post for sale again.
and put it down to experience.
if folks dont pay for goods pretty quickly, they probably arent going to.
bad luck if he/she was made redundant.
but if not able to pay, perhaps you should let the seller know, so they are able to relist.
you did say you werent in a hurry for the payment to.
then again , not contacitng a seller, is at best , rude.
 
Goods were sent. The member had a lot of Itrader positives and all our details were exchanged. ie, phone numbers, address, etc.
He emailed me for my paypal address a few weeks ago but no payment has been made and all my other emails and calls have been ignored.
I know there is nothing the mods can do on this issue i was just hoping there were some other options.

If the goods can no longer be paid for, the member should at least hand them back.

None of us are immune to the latest recession but there is no excuse for not contacting the seller or replying to phone calls etc.

As a last resort this person should be named on the forum ....
 
I would leave it a while or the 'buyer' will be on his guard if he's reading this thread, then as a matter of principle, drive to his address arriving early in the morning and knock him up. Then with your foot in the door, ask him to pay, or state you consider him not paying as theft, and you will only leave with your property.

Why did you send the goods before you received the money.

Had this happened on ebay then I am sure you wouldn't have sent the goods, regardless of if this person had 100% feedback.

I really do hope you get either your stuff or your money back.

To be fair with the things I've sold on here I've always looked on it as if there has to be trust on both sides of a deal. The buyer has to trust that the item is as described, and not a load of beat up rubbish, and the seller has to assume that the buyer is actually going to pay for it. I wouldn't do it on eBay as it's just too big, but I have done it on here with no regrets at all.

I can't comment on this individual deal, but most certainly don't start as a conscious attempt to cheat someone. It's just that circumstances such as redundancy and so on can overtake people. I've lived through it years ago and it's no joke trying to prioritise between feeding the kids or paying the mortgage. Other things can take a back seat, you've every intention of paying but then fear and embarrassment take over when you find that you can't actually pay.

Probably the best course of action is for the buyer to return the goods to the seller?

It may be the case that the buyer is trying to raise the cash to either pay for the goods or to pay for return postage.
Non contact is a bit rude though, he/she should at least communicate their position.
 
has the buyer logged on this forum since you sent him messages ?

I too was made redundant last year and i know what its like to have no money however i think the least he could do is keep you updated on his payment plans or return the goods
 
just to put the record straight, it's me that hasn't paid up ! simply because for the last four and a half weeks i have been in hospital having suffered a sub arachnoid haemorrhage...a stroke in laymans terms, now i'm out and have very little memory to work with, i'm sorting things as they catch up with me, apologies to craig but there really wasn't much i could do about it ! just waiting for his paypal addy so i can settle up. those who know me or have dealt with me will know i don't welch on a deal without very good reason and i certainly don't ignore people !

anyway, water under the bridge and all that :D

I too have suffered from a non-paying TP member who claimed to have gone in to hospital. He has since come out of hospital and still not paid me. I have named and shamed in the appropriate thread but I'll be very careful not to be caught out again. I'm also never going to forget he owes me money so if I ever meet him he'd better watch out.

Glad to hear you're doing OK and picking up the pieces. Not an easy thing to go through.

It's also nice to see the matter of this thread come to rest positively :thumbs:.

Shame things come to that ... I wonder if your buyer ever frequents the forum? If not, may be worth your while to presume that something not so good has happened to the buyer preventing him / her from completing her part of the deal :shrug:

I only say this as I was once in the awful position to have not paid for an item, and it went on for years. I don't want to go into the whole sticky matter, but things do happen that are out of one's hands ... thank God, that matter of mine has since been resolved and settled. The store I owed money to are my biggest suppliers back in Saudi and I still do good business with them. That doesn't reduce the amount of shame I continue to feel, regardless of how genuine my excuse may have been.

You sold him stuff on the understanding that they were going to pay for it. He(assumption) has refused to payf or it without a dispute being raised by them. Smacks to me of good old fashioned theft. Get the cops involved. If they try and fob you off saying it's a civil matter, mention bilking. Otherwise if they owe you lots of money, help yourself to something of theirs of a similar value. You can't profit from a loss but an alloy wheel off a car maybe:D
 
What actually happened was that we did a trade of goods and there was meant to be a payment my way as well. The trade has happened, he sent the goods he promised but never made the payment. Unfortunately he lives 250 miles away otherwise I'd have knocked his door down by now and taken matters in to my own hands.

I've just recieved a PM from a very helpful TP member about a way to take cheap court action to recover the money so I'm looking in to that.

Now that's just awful, and I can't understand the logic.

That aside, there is the matter of principles and common decency which has to be maintained; I am not too sure how practical it would be to take things any further. Thank God, I've never had to go down that route with any transactions, though I had been tempted to do so with The Car Phone Warehouse (long long story) back in 2007!

Best of luck, and I hope you get to teach them a very good lesson.
