So I was going to submit a photo into this Nokia Lumia 925 Low Light Competition. But read the following in the T&C's. I got the impression this didn't sound too good. I'd like to know what the members of TP think.

"7. Grant of Rights. By entering the Contest, entrants irrevocably grant Sponsor, its subsidiaries, divisions, affiliates, designees, clients, sponsors, licensees, and advertising and promotional agencies, an unlimited, worldwide, perpetual, non-exclusive, royalty-free, unconditional license and absolute right to edit, post, publish, store, copy, transmit, publicly display, and exhibit, the Work (in whole or in part) in connection with the Contest and/or the promotion of the Contest. Upon Sponsor's request, winners agree to sign any and all legal forms deemed necessary to license or assign all right, title and interest in and to the Work, including without limitation, all copyrights associated therewith, in exchange for the Prizes set forth above."

The competition can be found here: http://conversations.nokia.com/rock...5-low-light-photography-for-nokia-and-burton/

Cheers

Standard terms for almost every major photo competition, they don't want to pick a winner give them a prize and then have to pay to use the photo. For normal entrants they are only taking the right to use the photo in association with the competition which makes sense otherwise they could never display the entries.

Not relinquishing of copyright. Any competition that asks for that is merely a rights grab and should be avoided. Many ask for rights to use the image as they see fit, yes, and to be honest, that's a free tear sheet for you... not much wrong with that in itself. I'm slightly concerned with the broad range affiliates they list though... theoretically, that could cover an almost endless list of people, organisations and companies.

This is most definitely not something almost every competition asks for.

It's only the winning entry they want copyright of and I'm not sure it's as unusual as you think. I certainly wouldn't call squiring copyright of one photo a rights grab just a business deal they give you a prize and some exposure you give them the picture.

I would. Why would they need you to relinquish copyright? You'll have already agreed them full rights to reproduce the image as they see fit... what do you want copyright for?

Sorry... but loads of competitions do NOT ask for that.. including the biggies like AoP, Fuji, Nikon awards etc.

Entering a competition should not mean you give up copyright and moral rights, even if they do ask for exclusivity.

Everyone gets hung up on the word copyright like giving it away is such a huge thing, would everyone be so upset about it if it said exclusivity and the right to sell it for profit? It's one image in a competition and the t&c's are clear if you don't like them don't enter but don't make it out to be some huge rights grab. If the said they were claiming copyright of every entry yes that's a rights grab but this isn't.

Relinquishing copyright could potentially mean you couldn't use your own image though, where as exclusivity usually mean you just can't sell it to anyone else.
