I have our house up for rent. So far I have had over 100 applications. Happy days. The thing I have noticed from the returned applications, the number of "single mothers" wanting to claim single mother rent assistance from the DHSS but they openly have declared that they are living with a partner, some of which actually work ...... I don't really care how they pay the rent as long as it is paid nor do I care who they live with.......but should this loophole be closed? Is there a difference between single mother assistance and any other assistance?

If they are stating they are single mothers but li\/ing with someone then they are not a single mother... if the partner is on a low income then they can still get help, depending on their earnings.. i think if someone stays more than 4 nights a week they are deemed to be more than 'just \/isiting' but it's classed as low income family and NOT single parents..

It's now classed as lone parent or low income family i belie\/e

Did that e\/en make sense?... i you renting your house through an agency?

Used an agency once and they were useless....so I have always dealt with tenants myself since.....but there is Def a rise in this type of application.....

You many not care but here is something to think on, if you knowingly assist someone to commit fraud then you are equally liable to prosecution

Have you had applications from people not on benefit (at the moment)?

If so then just rent to them and keep it simple.

Yes most agencies care useless, i can imagine that that is why people are not caring what they put on the application, they won't get away with it through and agency but pri\/ate they can.....

If you ha\/e an application with someone that has stated they ha\/e someone li\/ing with them then you need to ha\/e them both on the form... they then can't get away with it because they ha\/e to show the contract to the housing association

How do you work that out? I am providing housing, willing to accept dhss but how they go about claiming it is their business. At no time am I trying to deceive the DHSS. I merely fill out the paperwork they send and it is up to them wether they grant assistance to the tenant/tenants. Then if the tenant has claimed wrongly it us surely them who have broke the law.

Don't get so defensive - I went by your initial post

I also said: "....if you knowingly assist....."

Sadly you would be open to prosecution because they've openly admitted to you from the outset that that is what they're going to do; however, unless they've put it in writing they'd be hard pressed to prove it.
Be safer to rent to employed I'd have thought.

Thing is the few that try and get away with things like this gi\/e e\/eryone a bad name and thats unfair.

I forward all information to the dhss. I never withhold any information given to me not do I try to mask it for financial gain.I don't need to as I can get lots of employed tenants. As per original post I was merely wondering if they could or should close this type of loop hole

From experience, I would turn them away. I know it's rude to judge but having let properties to tenants on benefits, they tend to ruin the house and abuse it due to the council paying their way. In reference to benefits, a single ''Lone parent'' will receive income support - the reason I know is because I'm one of those unfortunate people that had worked for DWP for nearly 6 years! If you receive any information regarding a tenant and their status then you should report it, at the end of the day, people are moaning about people on benefits and you have a prime opportunity to put that forward. I'm not sure on the legalities of willingly accepting a tenant who has disclosed information regarding to her circumstance of being with partner. Also, in the eyes of the DWP, if a common law partner stays for 1 consecutive night per week - this is classed as common law cohabiting and you will face criminal charges for it. Basically a night here and there is fine as the law accounts for friends staying over etc but if you are claiming a lone parent benefit you are legally stating that you are a single person with no other means of support :)

Don't advertise the let on Gumtree either, you'll get nothing but text messages, emails that you would need a forensic degree to understand the dialect etc!

they haven't admitted to anything.the application I send them asks if they are applying for

This would suggest otherwise

But in answer to the original post then...yes, there are lots of loopholes used by benefits cheats that should be closed.

Is this really a loophole?

It is not someone cleverly manipulating particular regulations to their advantage, they are simply lying to the DWP (and/or the housing benefit section of their local authority). There is nothing the appropriate authority can do about it until some evidence comes to light which suggests the claimant may be trying to defraud the system.

I have no idea whether you could face any charges or not, but do you want to rent your property to someone willing to commit benefit fraud?

No intention of letting it to someone committing fraud but is the tenant/tenants have give me the correct details and dhss grant them the money then I am ok with that....I certainly will be no part of a fraud and will report details as given to me by the tenant/tenants

Have secured a working professional for the lease now

If you want a 'v', hold down the left hand Alt key and type 118 on the numeric keypad, then release the Alt key.

Damn it doesn't work on the laptop... that is cool thought i had no idea it done that

archangel i had a guest house as a business venture some years ago and was faced with the same problem , the female tenants moved the boyfriends in usually without even bothering to ask .the main problem is if they get snitched on by a jealous ex or a friend they have fallen out with ,the DHSS or council then investigates there claim .

if found guilty the onus unfortunately then rests with you and the council will claim back overpayments made either directly from future payments to yourself or via court action against you .no matter that it was not your crime and they would then advise you to take similar action against the claimant to get your money back ,thats if you can actually trace them as rest assured by that time they will have done a runner .just keep note of this for future reference its a fact i learnt the hard way .
