New iPhone 4S - switches off on its own.

Before I head to Apple care, I thought I will ask. Got a sealed BNIB iPhone 4S locked to T-Mobil from eBay. Even if the battery is around 60% the phone switches off on it's own. I have to then press the home+power button for the apple logo shows up and lets me use the phone again. The iOS is up to date.
Anyone facing similar issue?

Have you tried to do a hard reset on the phone ?
