Ok this is probably a bit of an exageration but they're going to decorate Liverpool in bunting for 08. Now the 08 logo is copyrighted. So if they fill the streets with the logo could we sell any image in 08? I'm going to email someone and ask as I feel it could be silly if they did prevent us selling images but it did make me wonder. Everyone's copyright mad these days and covering the entire city in a copyright protect logo would be annoying.

I think you could sell an image providing that the 08 logo wasn't the main focus of the image or the dominant part of it. I'm only guessing mind you but using the Alamy guidelines as I understand them you can submit an image that includes a car with the badge but only if the badge (and maybe the car, it's been a while since I read the terms) isn't the dominant part or main focus of the image.

Who knows, maybe the person who sorted out the contract for the bunting engaged their brain and sorted out some sort of licens for it's use in photographs. Doubt it though.
 
If you took a picture of your local highstreet do you need the permision of the shops! no! I would have thought the same would apply.. you are in the public domain and not reproducing the logo for gain....

HAHA - I wouldnt be so sure. I once went to photograph a newly opened, open air, shopping centre. When I got there security told me I could photograph the open air shopping centre bits, but if I included any shop fronts I needed to get the shops permission before hand. Not sure if this is because I was on private land though.....
 
I've had that too. I couldn't do a shoot with a model in a shopping centre.
 
A shopping centre is private land though?? I'm sure shooting from the drag on a public high street you would have no probs.

How about a mass TP protest shoot!! :)
 
Yup they can be private land. The Paradise Street Project in Liverpool is entirely owned by Grosvenor now. They own a huge section of town. Theres a whole bunch of streets. This does mean that their own security can throw you out for taking photos. Which is a bit worrying.
 
I've been told that i cant take photos in a shopping center before, strange the security guard didnt seem to mind all the people with mobile phones and small compacts taking random shots of their friends.

I wasnt even using that big a camera, it was an old nikon f401.
 
It just goes to show how messed up this country is. I really hate most of the population of this place.. present company excluded :D :love:
 
It sort of follows on from the Liverpool 'Culture Company's attitude to using their logo.

When the city was in the competition to win the Capital of Culture status, they sent business people and community groups loads of promotional material; posters, stickers, logos etc. As soon as they won, and no doubt paid a fortune for a rebranding / redesign, they became a bit more reluctant to let people use ANY form of branding, unless permission was given by themselves. Obviously in the age of corporate sponsorship, they than started charging anyone who wanted to use the logo.

I went down the honest route and emailed them, saying I was a photographer in the city, and would like to display the logo on my website and the response I received asked me to pay £20 000. I replied explaining that that was a little much for a small business (i.e. just me) and was they any flexibility? They came back with a firm no, so I put the logo on there anywhere, without any problems.

Personally I wouldn't worry too much about them 'copyrighting Liverpool' - I've sold probably a dozen images with the 08 logo on it, and a few, with that as the main subject in an image. Otherwise they going to have to sue every photography in the city, if they are serious.

David i have to disagree with you on this, if they asked for a photo of yours and you qouted a price, you would have the hump if they used it anyways without payment?
Although i dont argree with the city.
 
I think if you were going to use it anyway I would of skipped asking them and played the dumb card. Then you can't be blamed for anything.

Only if they catch you ;)

Seriously though, it is worrying. I don't know why people feel threatened so much by photos when we're watched by CCTV every day.
 
Which suggests to me that it might be fun to design and wear your own trademarked logo, then sue the CCTV people for photographing it :)

I certainly would have the 'hump' but then again I'm not trying to promote a whole city in the name of culture (or charge thousands for me stock)

In the end, and I guess with too many businesses refusing to pay the 20 grand, the Culture Company worked with the local chamber of commerce and a couple of local council business advice groups to form a new business club, which allows organisations to use a legit version of 08 logo for free;

Which I now use, to show that I and my business supports the city in the build up to 2008.
