I'd guess that your contract was with the Managing Agent, and thus in the first instance this is who you should claim the money back from.

Sounds as though you are embarking on a difficult journey, might be best to find yourself a solicitor.

cool, coz i dont know the landlords address :)

if i make a claim through the small claims court and they decide against me then does that mean i have a CCJ against me and will find it hard to get a mortgage?
 
You claim off the landlord, as that's who the contract is generally with, letting agents just set them up.

Do a search on land registry for the Landlords addres., costs about £3 and will give you the landlords address. If you lose in court, you lose your own costs. No CCJ :thumbs:

EDIT: Could do with some more info really. What are you claiming back? Deposit? What were the circumstances etc. PM me if you don't want to put too much info on the forum, or put it here if you want.

basically we lived there for a year and there was a problem with the ensuite. The drain stank of crap making the en suite impossible to go into and the bedroom stink. In the whole year it never got fixed. Just excuses. So i'm planning on claiming back some of the rent, after all its a breach of contract as far as i can see.

i'm in some agreement with you there, but its seems like the only way to defend yourself when people think they can walk all over you. Got to hit these people where it hurts (in the pocket).
i dont see why i should pay £13k rent for a flat that stinks of excrement when the landlord is supposed to fix these things.
Landlords think they can sit back and do nothing whilst someone pays off their mortgage whilst their investment goes up. Least they can do is stop it from smelling of **** :)
