Still feeling it now! A car pulled out of a junction without seeing me and I collided with him. It was a bit shocking I'm 19 and this was my first ever accident so I'm unsure what to do now! I've reported it to the police and been to the hospital. I have ligament and soft tissue damage in my right knee, so I can't walk at all without crutches:(! Bloody annoying when I wanna get out there and take lovely autumnal pics!

Does anybody have any advice on what I should do now, obviously I need to contact insurance company and give them my Accident reference number but after that I don't know:shrug:
 
Do you mean what do you do for claiming damages?

Everything will be handled by your insurance company. In terms of legal action, that will be determined by the police, and without being the investigating officer, I couldn't tell you what will happen there.

Contact your insurance company and wait to hear from them - they will be in touch if they need anything further. Oh, and rest up!
 
Did he admit liability?
 
Did you pay for legal cover, they usually try and sell it to you when you take out the policy, if you did their solicitors will be in touch, if not loads of solicitors will be in touch.
 
Did you get pictures of the scene? I would recommend even getting some now, maybe still with some of the debris lying around. Get some from the direction you were coming, etc. and describe the locations of vehicles at the time. Had to do this once when a landrover pulled out in front of me in my car. I was on a long stretch of road coming upto a set of bends, she claimed the road was clear when she pulled out and I must have been travelling too fast. I measured the length of the straight took pictures of the scene (all the vehicles had gone by this time) but I calculated I'd have to be travelling at 180mph for the road to have been clear when she pulled out (not really possible in a Volvo 360). The more things you can put down on paper to support your case the better.

Contact your Insurance company straight away! They will handle everything, bike damage, kit damage, personal injury etc etc.

Photos are very useful if you've got them. Witnesses even more so.

Keep a dairy of everything, phone calls (names, dates/times), hospital appointments etc etc insurance claims can go on and on

I hope your bike isn't too bad and you get well soon.

I did my left knee in back in August and I'm still off now! I crashed at Pembrey and got hit by the bike behind me dislocating my knee cap and tearing my ligaments, so I know how you're feeling...lol
 
as above really, get your insurance comapny contacted ASAP. I assume you got all his details..

Get pics of the location, damage to your bike, damage to you swelling marks etc..

Get a diagram of the place drawn up as insurance companies will more than likely want one...

Do you know any solicitors? i did and it helped a bunch but your insurance may have this.

Were there any witneses?

and again keep a record of calls, letters email, also keep any receipts for taxis, buses, details of lifts to hosptial etc, even stamps for letters. simply because if you go down the personal injury route they can claim for anything out of the ordinary.


Chin up and hope you feel better soon...ps buy a rucksack hobble round and get some pics..however resting would also be advisable

Start eyeing up a nice replacement for that 400D, plus a good lens or two.
 
Hey everyone thanks for the replies. I'm feeling a lot better now, the swelling has gone down LOTS and i can put weight on my knee but I still need a checkup on Monday. I notice a lot of people are talking about personal injury claim. People have been saying I should make a claim, however I just don't feel comfortable doing it as I've been talking to the guy and he's a really good bloke, just made a mistake. I just feel it wouldn't be fair seeing as my knee is recovering quickly. Obviously if I find out there's lasting damage I'll reconsider!

I hope that makes sense to everyone and I'm not just rambling incoherently :D
 
Even though he's a good bloke, what he's telling you and what he's telling the insurance company might be 2 entirely different things. Happened to a mate of mine when he was knocked off his bike, completely admitting to my mate it was all his fault, told the insurance company something different. That was over 20 years ago and he still can't fully use his left arm & got nothing.

Start the claim process now so that it is all recorded correctly. If it then gives you long term problems you have a much better case, with all the evidence and you will get a better payout. And make sure that you do claim for the leather, helmet, boots etc etc. You will need to replace these after a crash.

And it is nt the bloke that is paying, it is his insurance company, who can afford to pay you for the discomfort you are in. It may well be that the other guy is a decent bloke who made a mistake, but he still shoved a 2 tonne lump of metal at you and it has injured you. I encourage you to claim because I used to work in one of the claim hotspots of the north, in an industry where I encountered accident victims daily, and they woudl claim even if they were fine, because it was an easy couple of grand. SO when I come across someone who has been genuinly hurt I encourage the claiming.
 
Thanks guys. I definitely need to have a think about this and sleep on it, you have convinced a bit. If I'm honest the main reason is I'm very nervous about it, I'm young and this is the first big thing that's happened to me that I need to take control of. The process of going through all the legal stuff is just very daunting :(

I think that is a little unfair don't you?

Sure, I agree it stinks the people claim when there are no injuries but Lukas has been genuinely injured by the accident - are you suggesting he should not claim :shrug:

Your insurance company will sort out your bike - but you have all your gear to think about as well - does your insurance cover this?

Definitly get in touch with a solicitors the specialise in bike accidents. The important thing is this accident should not cost you anything. Also consider the possibility of needing further treatment on your injuries - ligament damage can take a while.

Don't let the fact the guy is a nice bloke blur your vision on a claim - If he's a nice guy I'm sure he will understand - and of course not want to see you out of pocket by his mistake!

Did you not read what I wrote? I encourage him because he is hurt. It winds me up as much as you when people claim when they are not hurt, but this is not the case.

As someone else has written, one of their friends had a bike accident and is still feeling it 20 years later. If you had the possibility of pain for the rest of your life, do you not htink you are due some compensation?
