Insurance claim - can they keep my Ipad?

I dropped my iPad two weeks ago and smashed the screen. called Apple who say the screen cannot be repaired (I know people do but it leaves the apple warranty invalid).

Decided to claim on house insurance, sent them photos, copy of receipt etc.

They arranged for a company to collect it for evaluation. When I called and arranged collection even though I have told them it cannot be repaired, the gentleman on the phone said that I almost certainly will not get it back again once they have it if it cannot be repaired, as it will belong to the insurance company and I may be able to buy it back as salvage.

Is this correct? surely, it is my property still and even if they send me a cheque to replace it, the original is still my property.

Without being any kind of expert on this, I think the insurer is correct. The insured item ceases to be yours once the insurer pays out for its replacement.

Think about car insurance as it is probably a more common example of the same thing. If your car gets written off and you claim, you get a cheque for the value of your car, but you don't to keep the car as well unless you buy it back from the insurer. The insured item becomes the property of the insurer once they pay out to the policyholder for the replacement cost. So the insurance puts you back to where you started, with a working item (ipad in this case), it doesn't put you back to where you started plus a broken item.
 
ah ok, see I was thinking more of, if I damaged my carpet, sofa etc .. they would not take that. But in the context you put it in, it makes sense. Thank you. Just need them to speed up now and hopefully pay me for it before I go on holiday.
 
No if you have been sent a replacement, or the money for you to replace it yourself then it now belongs to to the insurance company.

They may well try to sell it for scrap or refurbishment to re-coup some of their loss. You give up your right to it when they give you the money.

Personally if you can still use the touchscreen then I'd do a backup to a computer (ready to restore onto your new one), and then do a hard reset to wipe it before sending it away.
 
that is how it worked with my pc when it was replaced
they probably want to check the model etc

I'm pretty sure you could ask for it back so you can make sure to your satisfaction that all your personal details are thoroughly deleted to avoid identity theft...

After reading what some of the above members said, I have to agree with them, it makes senses. After all, if they pay you the money which you can then buy a new iPad, supposing if they were to give back your broken iPad, what's to stop you being lucky enough to know some ex-Apple employee who could actually fix your iPad with spare parts, and you end up with 2 iPads, your broken one that got fixed and your new one which you bought with the money from the insurance? I can see their point when talking about cars, what's to stop you using the money from the insurance to buy a new car, and yet sell off your crashed car for parts, maybe even if you're lucky enough to find someone who could restore your car? Yeah, I can see their point. And if the insurance pays you, yeah, i can see that they need to have something to recoup the payout, may as well keep your iPad or your car and make money out of it.

So if you would rather prefer to have your old iPad back, say you want to remember it by, put it on your wall with a label saying: "RIP - My first iPad" then yeah, I can see their point that you have to buy it back. Or you could have decided not to claim the insurance and opt to save up for your next new iPad.

Mmmmmm.... If my old 35mm cameras gets broken, I'm keeping it, I have fond memories of my old camera.

But mind if I ask you guys, I know that if you crash your car, claim on insurance for repairs, your insurance will then go up a little, in order to recoup the payout, but if your car is a write off, you make it sounds like they keep it to get to recoup the costs, do that means they don't have to make your insurnace go up?
 
Yes my insurance will go up, the broker told me that when he tried to put me off claiming. If it jumps up to much I will shop around.

yes but a carpet etc will have no salvage value...

You should always shop around unless you get it for nothing. :thumbs:
