HTTrack - is it legal?

Hi,

I have become aware that someone has copied my website with HTTrack Website Copier and has now uploaded it to the internet as their own - mine was already off-line when I became aware there might be problems but it seems he had already captured it.

I have emailed the man last weekend - but he has not replied.

I am just wondering if I have any right to demand he takes his website down - after all it is entriely my work - apart from a few mistakes which seem to have occurred with the html - I wrote it from scratch. I wouldn't mind so much if he had asked me - but just to take it - and then not to answer any of my emails ... I am not amused!!

The tool used to copy your content is immaterial; indeed, you should be using tools such as Wget to obtain and save and prove the dates of files he's uploaded.

You own the copyright of text and images you've created, unless you've assigned them to someone else. If the design of the site has also been copied that should strengthen your case.

Thanks for that - it makes interesting reading - and I definitly seem to have a case - it is not similar - some pages are identical. Question is now whether he will come quietly!

Well if he won't, drag him along kicking and screaming.

If I'm understanding correctly and he's taken an exact copy of your site and content and is passing it off as his own, then there is absolutely no excuse. If asking politely doesn't work, then start ramping up the pressure by threatening to take legal advice and take it from there.
