How bad is the background on this image?

Snapping images at a local running race on Sunday. Taking photos of the runners coming in when this toddler walked in front of me. Snapped him and now they want a copy of the image. It was a fleeting snap as other runners were making their way to the line. The shadows are people and fence/kerb edges. How much does it detract from the kid's face. Is there any way in PS that I could get rid of them?

Since it's a pick of a child outside at an event then I'd say it wasn't a problem - different if you'd been doing an organised portrait session. To reduce the impact of the legs & fence I'd consider cloning out the legs and/or darkening the edges of the frame using gradients/vignetting.
 
It was an event, it's inevitable that you will get unwanted artefacts such as you described, there are many things outside your control in situations such as that, if you wish to make your images as clean as you would like then it's something you will have to do in post. As was said above,
I'd clone out the legs and leave it at that.
The family are obviously happy with the image so do the quick edit and leave at that.
