Friends car used in BnQ print?

I have a friend whose camper can has been used in a print for BnQ. Im still trying to get the rest of the info out of him but he aint happy about it.

Legally can they do this without his permission?

The photo used is not his, just the van but they havnt changed the reg or anything.

Ill get more infor when I can.

I don't think that you can copyright an image of your vehicle unless it was taken by yourself. If the image was taken in or from a public area I don't think there is much that can be done really.
 
unless they own the copyright to the car there is nothing to stop B&Q

What's he narked about? I'd be chuffed, it's got to be worth a few quid to him when he comes to sell it. :shrug:
 
I dont think he will, hes got 5 ha ha!

I figured that and yes Im pretty sure its that one. Need to dbl check with him but hes not answering, think hes gone to the pub in disgust ha ha!
 
just checked the reg and it is that one. Looks like an older one though as it has a few changes now but yup.

So basically public photo, public place free world an all that?
 
I've lost track of the number of places that images of my last car appeared. As they were all taken in public places, there's not a lot you can do.
 
I am sure B+Q would have all the legal bases covered, however if he is that upset about it then maybe he should contact B+Q. As I see it he has the options of
1 Being happy that is car is thought good enough to go into print
2 Contact B+Q about removing the photo
3 Ask B+Q that he should be mentioned as the owner
4 If its part of a B+Q promotion then he should be paid if he can prove to B+Q he is the legal owner.


As he presumably didn't take the photo he doesn't own the copywrite, and the van was parked not on his own private property but on someone elses I don't think there is much he can do about it except lodge a complaint and see what B+Q's reply is.

These are just my thoughts and have no legal bearing

What's his basis for complaint? B&Q are only selling it as a decorative print that will have been produced by some company specialising in these prints. If they have any gripe surely it should be directed to those for producing the prints.
 
He should be chuffed. It's obviously taken at a VW camper show, and he's got the desired result. That's why you have a posey motor isn't it?

Anyway, he has no legal recourse whatsoever.
 
I would suggest he take advantage of it, contact B&Q and see if he can blag a free print, then offer the van for sale as the one used in the B&Q advert and bung a few quid on it for that.
If he's really miffed I would suggest paint Focus DIY on the front and park it outside B&Q head office and see what happens.;)

Is that a public place though?

If it's a private area that has to be paid to get in to does that not change things?

I think the main issue here is one that people seem to believe that they are entitled to sue anybody they feel has wronged them for financial recompense thanks to the no win no fee society that we now live in.
 
The thing about private property is that you can, in theory, stop people from going on it and therefore stop them taking photos. But once the deed is done, it's too late.
 
Question is if any member of the public can go on private property such as a car show paying or not, is it still private or not during the show time.

While my knowledge is grounded in criminal law, these would still be considered "public" places, whether a fee is paid for access or not - since any member of the public can purchase a ticket to enter.
 
They haven't even made a decent job of the print. The van is too close to the left hand edge and needs more space. It's not horizontal and needs a slight tweak. The other van to the right of it is a distraction.

As for the original question, it's a dead end. B&Q licensing team will most likely have taken the image in good faith so any issue will have to be taken up with the photographer. Can't see it going anywhere or being worth that much to him as the owner of "that van used in the mediocre image sold by B&Q and slated by members of internet forum Talk Photography"

I tend to agree.

Maybe I should get in touch with B&Q about selling them some better photos of split-screen vans.. ? :)
