so our little town has had a ton of flooding but no worries because flood defenses were installed to protect a small clump of houses near the river
you can see the wide open flood gate just above the cars in the picture that nobody could be arsed to close
so the fire brigade have been and pumped out the 20 hoises basements and all the cars will be written off, well done residents.

Whose job was/is it to close the gate? Residents or council?

the residents of the cluster of houses they had the keys to the padlock that held the gate open or closed,
a few have admitted they even received flood warning text the evening before and ignored them.

a guy at a nearby industrial unit was there at 4am moving his cars and equipment to higher ground and even tried to allert them but they all just slept on

Would this then nullify the house insurance?-assuming they had any.
 
Waw! That is not good. Surely the insurance will wash their hands of paying out there?

The question of "whose job was it to secure the gate" occured to me to.
Would this then nullify the house insurance?-assuming they had any.
I can surmise that the flood insurance is promolgated on the gate being closed.......

As above, I surmise they have snookered themselves by ignoring the warnings.

NB even more complicated if any residents are tenants?

Problem is when you give something to people for free they don’t value it. Best thing to do is take it away, let the residents club together and buy their own and then I suspect they’ll close it.
