Try it at it's maximum aperture at 70mm, probably F4.5, chances are it will work fine. I'm assuming here you've set aperture priority or manual and are selecting the aperture. As you reduce the focal length the max aperture increases and that's why you're getting Err99.

The problem is that it's a issue with the lens, it's not compatible with the newer bodies. Sigma might be able to rechip it but in reality it's probably not going to be economical to do so.

I had precisely this issue when I bought the 30D - my old Sigma 100-300mm & 28-80mm were just too old for the camera to "talk to" - hence the camera was confused and threw up Error99 at anything other than wide open. (Error99 is Canon-speak for "Well I dunno what's wrong, do I?!)

As Dod said - it will probably isn't worth re-chipping unless you are particularly attached to the lens. Just look on it as an excuse to buy new glass! :D

Had to ditch some reliable lenses as a result of this when my work upgraded to 30Ds

Error99 is catch all message that means 'somethings wrong but I don't know what' try cleaning the lens contacts, that has fixed it for some folk in the past. If it does turn out that the lens is too old, Sigma may be ale to re-chip it for you, it's worth giving them a ring to find out the cost if the lens is a good'un.
