Dust in elements?

Ok, been looking at buying a Canon 28-70mm f2.8 L USM and have found some at very attractive prices. One mentions it's in excellent condition (pics look great of it) but has a tiny bit of dust in the elements. Now, I thought the L lenses were pretty-well sealed? btw, this lens is on Usedcameras.com and they're (supposedly) pretty reputable.

My only other concern is the date code--UN--as, I believe, that indicates it was made in 1999 so it's an older lens. Good price for the older lens and it seems that shouldn't deter me. However, I've found one locally for about $50 more which is only 3 years old.

Just wanted to get opinions of you all here since you all have more experience with the equipment than I do.

Which one you go for is up to you, although for an extra $50 dollars the younger one might be a better bet.

Dust does find it's way into lenses unfortunately, but it's highly unlikely to have any effect on your images at all, so I wouldn't worry about that unduly.

The 28-70 is obviously an older lens which was replaced by the 24-70, the thing to ask on a older Canon lens is if the zoom ring is free running but not loose, that the front & rear element are free from scratches and worth asking if it has been serviced or calibrated with receipt to prove.
 
My records show that the 28-70L was discontinued in 2002 so the second lens isn't going to be only 3 years old.
