A lorry driver was filmed from a police HGV reading a book while driving along the M60 and given a fixed penalty notice.

This seems a very light penalty for something so potentially dangerous, especially as it was a conscious decision by the driver. This wasn't a dangerous situation because his vehicle was badly maintained by the service crew or badly loaded/overloaded by someone else, he decided to have read while driving.

I reckon this and the use of mobiles should result in a fine and the vehicle being seized. I think only a short period (say 24 hours) would be enough to change behaviour.

What does anyone else think?

It was driving without due care or attention though, wasn't it and yes highly dangerous.
He got fined and points on his licence
Even a roadworthy vehicle can be driven dangerously, in fact you see a lot that are and don't get caught
 
I saw it on the news this morn.

Similar to `speeding` offences, why can't they fine the offender & make them pay for & attend a full day course?
 
Death by beheading would be my choice. Especially if you've got kids in the car at the time. Might be thought of as a tad over zealous in this day and age though.
 
Ok, while a book is different, I am sure we have all read a map while driving (well, 10 years ago + perhaps).

M25 jnct 11 to 16 6pm every night 50% of people are on mobiles/texting, anything being done about it? Not a chance. Whilst we have no deterrent we'll haveeople breaking the law. Just wonder what these people would say if one of their loved ones were killed by someone who was doing what they were doing?

I'd have thought undue care and attention is a bit light, and careless or dangerous driving should have been the charges considered.
 
I think you may want to rethink that. ;)

There was a crackdown on dangerous driving, but they were not charged with that. A FPN isn't issued for a breach of section 2 of the RTA. A summons to court is by the CPS or the PF (if you are based in Scotland).

I'd have thought reading a book at the wheel would fall far below that of the standard of a careful competent driver and as such a section 2 complaint deemed viable by the CPS.

Steve, read it again. The charge is Without due care and attention, NOT Undue care and attention unless you think they were giving more care and attention than was due.

Please accept my humblest apologises for mistyping what I meant.

Without due care and attention. The sentiment of my post stands, it seems a light charge given there are section 2 and section 3 charges available.
 
Heard on the radio yesterday about a guy in Glasgow driving whilst banned with both legs on plaster

Not semantically. Undue care and attention would be too much care and attention while without due care etc. is the opposite.

I think the correct terminology is driving WITHOUT due care and attention.
 
Here's the proper definition from the official website.

Careless, and inconsiderate, driving.

"If a person drives a mechanically propelled vehicle on a road or other public place without due care and attention, or without reasonable consideration for other persons using the road or place, he is guilty of an offence."

Rarely that part of the M25 these days....I used to go to Heathrow a lot...but in the car always use Siri and now Cortana to read/write/post messages...I seems to understand my euro/English accent rather well....

Such a shame there's nothing she could actually be charged with.
what about driving without due care and attention?.charge covers anything which causes a driver's standard of driving to fall below an unacceptable standard. Mirror once carried a story of police helicopter scrambled because someone was seen to be eating chocolate bar while sriving Methinks along the lines of a masonic handshake involved

Because the CPS wouldn't bother pressing it, it really is that simple.

And if the police really did send out the helicopter for the alleged mars bar incident (which doubt), they're the muppets for doing so imo.
