Hi Everyone!

I'm Laura and I'm new here and I'm looking forward to speaking to you all :). I'm an amateur photographer and I am not associated with any company.

This is a bit of a strange one and I didn't know where to post this so apologies if I have posted it in the wrong place or I am duplicating threads. I have recently volunteered to take photos at a run for a company. They have asked me to take photos before the run around the running track and after. It has been an email conversation and the lady said they already have a photographer but she is happy to have me volunteer too. I wondered what the legal stance was on taking people's photos whist they are running, I will not be able to ask their permission! Also she has not given me any details of if I should have a disclaimer to show people when I take photos. I am not part of any company, I am taking the photos to build up a portfolio and reputation around my area.

Please could anyone help?

I'm by no means a legal expert but I would imagine that everyone taking part in the run will have agreed to some Ts & Cs that the company have drawn up, including that their photograph may be taken and published for publicity purposes. If they already have a photographer then I'd be surprised if they don't have this in place, and also have an agreement with the other photographer that at least covers copyright. Any permissions agreement would of course cover the runners only and not the crowd so be careful of that.

I'd ask your contact what they have in place and then if necessary state over email that you're very happy etc to volunteer and state what you're expectations are regarding copyright and the company's administration of permissions etc.

you don't need their permission - simple (in the UK you don't need someones permission to take their photo on private land if you have the landowners permission (this essentially boils down to the event organisers permission as they will have dealt with the landowner in licencing the set up of the event in the first place) theres also nothing to be careful of vis a vis the crown because as per you don't need their permission anyway

The end user (ie the company) might need their permission if they used the shots in a way that implies endorsement of their product (ie as advertising rather than editorially), but thats their prolem not yours (and will probablybe covered in the race/admission T&Cs anyway)

The only thing you need to cover with the company is what their expectations are of you, and that you'll (presumably) retain both copyright and the ability to use the photos in your portfolio
