I read something earlier about a farmer who accidentally shot 2 burglars while aiming his gun at a fox.

Yes, that's the story, and as the burglars decided not to make a complaint there was no evidence that he had done anything else. But the police revoked both his firearms and shotgun certificates anyway.


His story (which I'm sure is absolutely true) reminds me of my dad's Courts Martial defence when his 'mistake' resulted in the whole battalian turning out many years ago on the North West Frontier, where locals would creep into the camp, slit a sentry's throat to steal his rifle.

He was on perimeter guard, the most dangerous post. He said that he heard a rustling in the undergrowth and then challenged in 3 languages as required. He heard what he thought was a rifle bolt going home, so fired at the sound (causing the bugler to sound the alert, machine gun posts to open up and everyone to rush to defence positions) It transpired that the sound had come from a bazaar dog, but there were no witnesses so he only charge that stuck was of wasting ammunition - the single round he fired, not the 6000 or so that his comrades fired.

After that, they withdrew the Lee Enfields from the perimeter guards and issued them with shotguns instead, which made them much safer.
 
If he hit the burglers while shootiung at a fox then he didn't wait until he had a clear shot and should definetly not have a gun. He should lock the geese in a shed over night.

About as plausible as Kenneth Noye's defence in the John Fordham case, but the law is the law....

Do you mean a clear shot at the fox or a clear shot at the burglars :lol::lol:
 
Hmm depends whether or not he was lamping the fox, if using moonlight alone its plausible, and bear in mind it was his land, no public access/right of way and no way he could reasonably expect anyone to be there at that time of night.

However the reality is he shot at intruders attempting to raid his/his tenants crop of weed.
The police revoked his licenses as it was the only way they could get any sort of result from the case.
On the upside he should be able to get the confiscated guns transferred to a local RFD and then sell them, the same with the ammunition.
