So if someone takes a photo from say Facebook without a watermark and edits it are they allowed to pass it off as there own? And watermark it with a copyright?

No, not generally. You can use a trademarked logo/design with permission, and in my experience with motorsports-related companies, they'll not grant it easily.

If so, then no, I'd avoid using those as they may chew you up for it - not that it was hard for me to find those from all sorts of unofficial webites, personally, I'd not do it without permission (which they almost certainly won't give you even if you were accredited media!)
