A friend of mine took some photos of there dog to a high street photo shop to make a canvas, but whilst looking on eBay later for a phone cover, found one with there picture on it, where do they stand on this? Can the shops sell the image without there consent? It seems strange to me, hopefully someone on here can help.

No. The shop can't do this without permission from your mate, and is in breech of copyright. Does your mate wish them to stop?

No, not without consent. But maybe the terms and conditions of the contract between your mate and the photo shop provided the consent. How sure are you that that's not the case?
 
Are they sure it's their picture? It's been known before for similar images. Are they sure it's the shop, has that image been posted anywhere else on a picture sharing site, flickr?
 
Thanks for the reply, they are not into photography so I doubt it has been on Flickr, Facebook maybe, I haven't seen the pics together yet eirher, but thought I'd just get a feel for the law here first, it may as you say gave been lifted off another source, I'll pop round today and see if they match and if there was a contract.
 
It's very unlikely (pretty nigh impossible) there is a contract with a high street shop. It's unlikely to be in there terms and conditions either
