So, why would anyone choose this lens over the new "shorty forty" EF 40 f/2.8

Well, I did, for a few reasons:

wider field of view (useful on crop APS-C)
faster lens (f/2 vs 2.8)
closer min focusing distance

I do very much like the 35 f/2 - it feels much nicer than my nifty fifty, as it has a metal mount, faster focusing (although not USM obviously), and a distance scale window.

Some people complain about nasty bokeh with the 35 f/2, and sometimes it's not optimal - with the pentagonal highlights, but sometimes its lovely and smooth.

I think this is an underrated lens - it's optically great and a nice focal length on full frame or crop, but I have to admit the noisy focusing puts me off using it.
 
Thanks for the review any chance of some examples of the bad bokeh?

This and the Samyang 35mm are serious contenders for next lens. . . .
 
Not much bad bokeh unless you go looking for it. I'll try to find some for you. I didn't get the samyang as I wanted auto focus..
 
It's one of my favourite lenses, right up there with the 300 f/4. Definitely underrated.

It's a great little (tiny) lens which I used for about a year or two as my main walkabout lens on my 400D. Always pin sharp and accurate focussing. I actually miss it quite a lot, tempted to buy the Nikon 35 f/1.8 but I'm not sure if it's going to have quite the charm...
 
Since the pancake 40f2.8 is available so cheaply now, I'm not sure if I would still recommend the 35f2 over it. A hundred pounds saving is quite significant.
 
the pancake 40mm whilst quiet with the stm focus system is slower to focus
