camera shy and sick

Jesus H. Christ.

The amount of times I have taken photos of drunk, random strangers, I would be paying off my debts 20 years after I die.

"I'm going to impose a fine to remind him chivalry is not dead and when somebody is in distress you leave them to it."

is thatw hat we should do all the time then? Ignore people in distress? Drive my car accidents etc etc

Makes sense to me.

What, on this 'ere planet of ours, is chivalrous about "leaving her to it" for goodness sake?

The world's gone made I tell thee, mad! :cuckoo::cuckoo:

WTF has chivalry got to do with it.

If he'd tried to help her he'd probably get done for assault ....... or worse.

"I'm going to impose a fine to remind him chivalry is not dead and when somebody is in distress you leave them to it."

Not a very good example to put forward, especially from a sheriff.

A strange interpretation of chivalry... to find a women in distress you should leave her to it ??

ADDY ON BIT .. I think a few of us posted about this point at about the same time :)

Next time someone chokes in Edinburgh, you leave them to it and they die.. then what, manslaughter? In theory, you're screwed either way!

yeah unless you get the same judge it will be murder cause you must have bought them a doublek and thats why choked

Im sure you take take a photo of what or whoever you want in public?

When I went out for my mates birthday, she posed for a photo with a guy slumped over a bench, totally out of it. His girlfriend was sat next to him and just laughed when we gathered round for a photo

If she had tried to call the police, she would have been laughed at :/

Kipax, she was in a public place, therefore had no right to expect privacy (which is why the photographer was charged with a breach of the peace rather than invasion of privacy).

It is perfectly legal to take photographs in a public place.

Had it been a Sun tog and Jordan he snapped - the shot would have been worth a fortune - lol

However, he pleaded guilty to a breach of the peace and was fined for that, not for taking a photo - had he not pleaded so, I seriously doubt they could have gained the same result

Some of the lines in that report make me laugh....

The woman had been drinking with friends in an Omni Centre bar when she felt unwell and went outside for air. .......

Fiscal depute Mhairi Vernon, prosecuting, said Ms Smith had become unwell in the bar in the city's Greenside Place about 2330 BST on Friday 8 August.

Not that this illness was self induced of course.......

But Sheriff Kenneth Hogg said the matter "could be best described as exceptionally unchivalrous".

"The lady concerned was entitled to her privacy and not to have a passing stranger take a photograph," said the sheriff.

But isn't that what "street photography is all about... Catching the essence of the moment on the street ??

I would suggest that the "lady" in question may be liable to Breach of the Peace herself !

No it is not.. Would you like me to show you an example of where it isn't legal to photograph someone in a public place?

Quite. In fact, it could quite possibly have been the other way round, as it was not the photographer that breached the peace (he was quietly taking photos as he had done all day without incident it seems), but more the group of girls that would appear to have caused a commotion about the photographer being there.

Whilst we don't know the full facts, one would presume the young lady was "taken ill" in the pub as she too had been sampling the delights of the Edinburgh Festival all day (along with her friends) :suspect:

your not allowed to take pictures of a women being sick in a public place in scotland as it causes a breach of the peace.. you can twist the words and call it whatever you want.. but at the end of the day he got fined a hundred quid for taking a pic in a public place.. Also the police can stop you taking photographs in a public place of a crime scene if they think its hindering them..

ok legal not legal.. your splitting hairs with words.. fact is your now allowed to say its a public place i can take pictures... sometimes its not allowed... like free speech.. theers actually never been any such thing as long as man has been able to speak.. theres always been consequences for saying the wrong thing...

So is cctv unchivalrous?

There are loads of programmes about drunken idiots on sky all the time.

Hmm ok i have to ask then, does the law differ in Scotland to England regarding photography?

I do wonder if there is more to this story than is reported here (remember the other BBC Scotland story... gary)

In particular I wonder what happened between the time he took the photo and her friends called the police? I suspect they didn't turn up immediately! Note there is no report of how he behaved when the police did turn up.

man shouts at police and makes a nuisance of himself ..just isnt as good a story as man arrested for taking photo... maybe there is more.. wouldnt suprise me :)

His mistake was in pleading guilty.

And the judge is a halfwit.

Agreed. Defendant pleads guilty, Judge has no option but to hand down a guilty.

"could be best described as exceptionally unchivalrous" [sic]

Could also be described as unladylike to get ripped to the tits and chunder in the street. Another example of the skewed judiciary North of the border.

Exactly. If people roll over and take this sort of judgement instead of knowing the law and fighting it then it will only get worse.
