Blocked mobile phone

Hi All,

Looking for some advice please...

I purchased a used mobile from a retailer May 2017, over the past week Ive not been able to connect to the network, ordered a new sim, still doesn't work. Tried sim in another phone and it worked fine, I also tried their sim in mine and nothing.

I purchased a check mend report this morning and it has advised that the phone has recently been blocked and is under an insurance claim. That would explain the issue.

Contacted the retailer, they have basically said tough luck as its only supplied with a 6 month warranty.

Where do I go next? Police, credit card company?

sounds like whoever sold it to where you bought it declared it to be lost/stolen
the insurance company has got hold of the IMEI for it and logged it as such.
I suspect you have very little you can do apart from take the company you brought it from to a small claims court.

was it someone like CEX?

Yup, my thoughts exactly. It was Cash Converters.

I have proof of purchase etc.

I think it is a tough call as I suspect there will be some small print regarding this, worth checking the warranty.

6. Warranty Policy
When purchasing goods from Cash Converters stores via the marketplace, Customers are entitled to assume:

1. The goods they are purchasing are of satisfactory quality
2. The goods are fit for all purposes for which they are supplied
3. The goods are safe and durable
4. That where any written description is applied to the goods, that the goods match that description

If the above are breached, customers may be entitled to certain remedies which include refund, repair or replacement. But you will need to contact the store the item(s) was purchased from.

When delivering the goods to the address, if a 3rd party at the address accepts delivery of the goods on your behalf, we are not responsible if this individual fails to pass the goods on to you.
 
I'd get in touch with the insurance company. It sounds like the previous owner sold it to CC then waited until reporting it stolen to claim on his/her insurance. CC should have records of who sold it to them.

I don't know who their insurance company is unfortunately the report doesn't go into that detail. CC has the sellers details but they seem completely uninterested even after calling head office, area manager supposed to call me back. On hold with card company, see what they have to say.

you can't do that they just will not talk to anyone apart from policy holders.
The phone is toast @twist pursue it with Cash Converters and I am sure they will fold under preasure.

Plod then. CC are handling stolen goods (by the sound of it) so the police should be interested.

no necessarily when the phone was sold it was clear and correct, the onus is the seller who sold it on has committed the crime.
there are plenty of times this happens and in law the store has acted in good faith.
 
So, Checkmend are superb, they gave me the date of the blacklist along with network that made the block and insurer.

great stuff, I wonder if it is worth reporting it to the police as you suspect you have been sold a stolen phone?

dunno if it will help but to be fair its done for now so no point in holding back
 
Ah. I just wondered because EE has a clause which states the phone is their property until 6 months of the contract has passed.

Yes, the store probably did act in good faith but they're the people who have the seller's information available for the police and he/she seems to have NOT acted in as good faith as the store.

Moral of the story is, don’t but a phone from those places.

The advice from most sources seems to be not to buy 2nd hand phones from anywhere.

I reported to Action Fraud after calling Financial Ombudsman Service
 
@Nod behave with your don't buy any phone 2nd hand that is utter bunkum.
 
Surprisingly their insurance company didn't seem to care :confused:

They told me to go back to CC.

Probably cheaper for them to drop it and pay up than to investigate. They'll just keep increasing all premiums to cover the costs.

Yes agree with you Nod I'd only buy a second hand phone from someone i trusted
 
Re Cash Converters and the 'warranty', they're talking out of their proverbials. The warranty covers you for faults but your phone is not faulty, it's been disabled because it's been reported stolen or lost as said above. It doesn't matter if it's one week, one month or one year down the line if they sold you a stolen/lost phone they didn't have the right to sell you it and are responsible to you. Go back, kick up a fuss and get your money back.
