I've had a few photos published over the years, mostly for no money but for good causes or just my own hubris. I had a photo in this years Staffordshire Wildlife trust calendar (I'm February if you're intersted). I had some dog photos published in an American book about pets and every year since they've messaged me and asked if they can reuse the pictures. This year I very said no as they're making money from this and I've never had a dime from them. Should I keep letting them use pictures or seek better publishing where I should get something for it.
I've sold photos through online places like photos4u but nothing substantial.

+1 ^ surely an opportunity to now ask for payment now and for a set licence period (reviewable, when expiration approaches?)
 
I think there are a couple of ways to look at it - if the person asking to use your photo is selling something, it seems fair that you benefit from that too. If it's for charity, local good causes, or something smaller, I wouldn't have any problem with it being free - but it does depend on the context, and also value of the image.

The photos that have been reused are in a book thats on general sale in the U.S. I have no problem with the photo for the wildlife trust as that's a good cause.

I wouldn't be too sucked in by charities either unless it's a charity for a cause you feel strongly about. Many charity bosses earn huge salaries so why shouldn't you get paid for services rendered or goods supplied.

For many charities only a small percentage of what they make actually reaches their cause. When a charity asks me for a discount because they are a charity my response is usually something like, that's very nice but I'm not, I have bills to pay.

That's a fair point. I think I should take the same attitude as I do with friends and family. Which is to say I don't dondiscounts or give freebies.
 
I had a photo that was published on a website somewhere, and was then picked up and used for loads of holiday accommodation sites/blogs, was on the flyer for a conference, and then I saw it on the cover of a CD. I did contact the CD publisher - who was mortified, and offered me a free CD. As it was of Lake District Organ Music I declined. I only really contacted him to make sure he didn't pay someone else for my photo!

I did draw the line when I found it on someone else's photography course slides. I felt that if they were using my photo to advertise their course, they couldn't be that proud of their own skills!

And did he or did he not pay for it? Also, who supplied it to him i.e. who gave him permission/license to use it?
As it seem he is selling the CDs i.e. in part profiting from your work I would have asked him where should I send the invoice and retrospective license agreement.........and guaged my actions depending on his answers :thinking:

No - he didn't pay anyone for it. He found it on the same website as the other folk, on a 'Free-to-Use' photos page. Until then I wasn't aware that a) my photo was on there, or b) that it was 'free to use'. It turns out it was something to do with work, and they had assumed it was a work photo, when it wasn't. I'm not even sure how they found it in the first place - but that's the wonders of technology for you.

So, I don't think it was really his fault as such, and as I say - he was mortified to hear from me. I suspect he makes little to no profit. I can't see Lake District Organ Music being a huge seller!!

I once noted that some of those 'scrapping websites' have a system in place that should you find your images there, you can complain and request that they remove it :thinking:

I surmise that you are correct! At the very least, in your shoes I state in a license agreement that he can continue to use it for a token amount i.e. £10 and provided he puts an attribution note in the current stock and amends the case notes with a clear & bold credit attribution.

In other words make formally correct with appropriate agreement.
