Advice Needed : Wedding Photography - Consumer Rights

Hi all,

Wondering if you can offer some advice to help a friend of a customer out...

Her friend got married last September, but was't happy with the pictures she had received from the photographer. A complaint letter was sent, which unfortunately didn't get anywhere and eventually a pre-action protocol letter (threatening legal action if they didn't sort it) was sent.

The company then edited (or re-edited, i'm not sure) the photographs, but according to the bride/groom they didn't look any different. She has spoken to them again, but they have said the edits are final and they are not willing to do anything else to them.

I haven't seen any of the photographs personally, nor do I know this person directly so am struggling to pass comment on the photographs. Does anyone know what her rights are as a consumer?

Any advice would be greatly appreciated. Thanks in advance,

Did they sign any form of contract with the photographer?
 
Thay cant take the photographer to court simply because they "do not like there photographs". They would have to show some neglect from the photographer and something technically wrong with the work.

Without seeing the work we cant really comment and you would need to have a good look at the contract also.

If they have shown examples and the final results is the same standard as the examples then that is that product sold.
 
You can't really comment on photographs you haven't seen, and without more details theres not much we can suggest either.
It depends on whether theres a contract or not and what exactly is "wrong" with the pictures. Just because they don't like them isn't really good enough, that doesn't mean there actually anything wrong with them. I don't particularly like pictures of me but thats because I'm in them not because they are faulty or out of focus.
I'd be wary of posting pics on here, first off they are somebody elses copyright and secondly you have already implied there is something wrong with them, if they are in fact ok that could leave you open to action by the tog for defamation or something.
Really my best advice is to get them to contact a solicitor and get proper advice.
 
They could ask for a copy of the origional unedited files (if the tog still has 'em) and then pass them on to someone else for editing to see if they could improve them.

I dont know a photographer in there right mind that would agree to this.

Besides if there is something wrong with the photos an edit wont make a difference. The images are either "faulty goods" or there ok cant have it both ways.
 
Well if you had a choice of going to court or doing this to see if the customers can resolve the issue, then it would be something to consider.

We all know that with some good processing, many photos can be improved, and by viewing a full set of unedited shots, some which the togs may not have used the couple may prefer t their origional options.

And plenty of togs will give away a disk of all the photos, admittedly these are usually lower end of the market, but these do not sound (assumption I know) like a high end outfit.
