There does not need to be a contract - this has nothing to do with contracts. You can use the photo as it is your work, you own the rights to the photo not her. That is when contracts need to be drawn up. By you taking the photo, you own it and you own the copyright. Not the other way round...

End of the day she can't run away from the law. Copyright law is law.
