Actually Ben in Scotland it is open to the purchaser under SOGA '79 (as amended) to '...reject any goods delivered under the contract and treat it as repudiated.' if the goods sold are unfit for purpose. You'll obviously be aware that Kay is in Scotland and so the provisions apply in this case...
I've never had a problem either Slimbert and it would be naieve to suggest that no retailer can have problems but WEX appear to have had ample opportunity to resolve this one. There isn't much excuse for that.
The provisions covering Scotland actually provide a right to repudiate, never mind the whole "time to make good" thing.
In these circumstances WEX are a bit daft even bothering to ride it out. Simply to avoid the cost of hassle I'd be writing a cheque PDQ if I was in their position.
